this bitch is unmistakably part of the insurrection.
What is patently obvious ridiculous BS to normal persons will be lapped up by Alito and Thomas (at a minimum) unfortunately. Until the election happens they will just stall things and act cautiously, issuing rulings that will stall without being on the merits. If Trump wins the GOP bias/partisanship on this Supreme Court will become absolute.

It's very interesting, almost shocking because other judges almost never offer opinions to other judges about their concerns re performance on a case. But they did offer such opinions here.

Yes, extremely rare, as in almost never ~ barring an obvious case of implicit bias as in this case.

But also, there are no federal judges appointed with essentially zero experience in criminal cases (other than Cannon).

The Supreme Court really is dragging out Trump's crazy immunity appeal ruling to the greatest extent possible, as they've now fully guaranteed that the D.C. trial has no chance of proceeding prior to the election, regardless of their actual ruling. And fully assuring that the case will never proceed if Trump wins.

For all practical purposes, they have aided and abetted Trump in his crimes, at the very least massively delaying any prosecution for his crimes in (1) just hearing a case that should have had zero chance or consideration of granting Trump immunity from his "alleged" crimes, and (2) halting all court activity on the case while they pondered Trump's insane claim.

It is pretty incredible that the Supreme Court has decided that someone credibly accused of trying to overthrow the government should get a chance to be in charge of it again before that attempt is adjudicated.

Then again at least two of the justices seem to be down with the coup.

So far she’s been very successful at avoiding making any rulings that Smith can take to the 11th to have her removed. This seems to be very clearly on purpose as her goal is to just get the trial past the November election.

Their next session on Wednesday and Friday. And if they really want to punt, apparently they can extend court into July
I had read/heard earlier this week that today was the end of the session. I just looked up the Supreme Court calendar ( https://www.supremecourt.gov/oral_arguments/2024TermCourtCalendar.pdf ) and they seem to have a conference day scheduled for June 26th, so maybe they are going longer. That June 26th conference is the last thing on the publicly released calendar.

IMO there are two ways they can calvinball it at this point (1) issue a convoluted opinion that will require remanding the cases to the trial courts for some sort of factual determination or (2) not issue a decision but instead put the case back on the calendar for reargument next session. Either way will block all Trump trials until at least after the election, which is certainly the goal of the majority of the Court.

Nothing we didn’t know already. It was mentioned months ago, during the search, the order of some documents wasn’t maintained. The orange monkey lawyer argued it was vital this was maintained for their defense. So article just saying prosecution pushed back on that flimsy argument

She pressed government attorneys to provide more information about the funding of special counsel Smith's investigation, at one point remarking that the funding presents a "separation of powers concern."

She’s just making shit up now. She could have ruled on this from the bench, back when it was introduced. This has been thoroughly adjudicated, multiple times. I’d be curious what she’s expecting other than that 100% comes from the DOJ budget of the Executive Branch? Does she think Biden cuts us a check from his personal Burisma account and send it thru his personal attorney’s LLC? Or some other dumb ass assumption.

The last eight special counsels have been funded and overseen through the same process as Smith’s. It seems the defense argument that the prosecution is funded by the government, therefore it is invalid? This seems ludicrous on it’s face. If Cannon is actually considering this, and using it to delay further is even more ludicrous. The defense’s argument is that Jack Smith wasn’t a Senate-approved appointment. And he shouldn’t be. Because, you know, the whole separation of powers that our government is supposed to be founded upon. Which also means it is none of her business how Jack Smith is funded either. Which in no way invalidates all the other rulings made with respect to other special counsel appointments by many other judges.

My prediction: In the end, she’ll deny the defense’s motion. But not before she’s chewed up a lot more time pretending it’s a motion worthy of hearing.

Of course. If she were to rule the appointment wasnt proper, it will get appealed immediately and overruled by the appeals court where they’ll immediately remove her from the case.
