Yes, a person detained by ICE has the right to demand justification for their detention. Under the Fourth and Fifth Amendments, individuals regardless of immigration status have rights when interacting with ICE. Here’s what they can do:

1. Ask for the Reason They can ask the officer, Am I free to go? If the officer says no, they can ask for the reason for their detention. ICE agents must have reasonable suspicion of an immigration violation to detain someone.

2. Remain Silent. They have the right to remain silent and do not have to answer questions about their immigration status, birthplace, or citizenship.

3. Refuse Consent to a Search ICE agents cannot search personal belongings without consent, unless they have a valid warrant or other legal justification.

4. Ask for an Attorney Detained individuals can request a lawyer, though ICE is not required to provide one for free.

5. Request to See a Warrant If ICE attempts to enter a home, the individual can ask to see a judicial warrant (signed by a judge). ICEs administrative warrants (Form I-200 or I-205) do not allow them to enter without permission.

Remember a justification is required for detention. Looking non white or speaking a foreign language is NOT justification

Human nature has not changed in 80 years... how should it? "Greenman" is entirely predictable.

Sorry, I forgot curiosity was against the rules.
I've never seen or heard of a government official accosting someone on the street and demanding papers. Though I did have three of them stop by my job site and demand lots of papers. CSLB, Cal OSHA, and the Franchise tax board were all represented. They brought the project to a halt while looking at my paperwork and interviewing my employees. It was all completely legal.

I wonder why you would vote for a person that puts the rights of people like me in jeopardy. Since that applies to people of color I'm confident it makes you smile.

How many people just lose documentation in moves and whatnot, or go for a walk outside their house without ID? I don't think it's a good idea to subject people to arbitrary arrest and detention, nor does it seem to be an efficient use of government resources.

I thought you cared about efficiency in government spending?

I will post for Greenman. “Be prepared for a DOJ investigation notice. How dare you use the first amendment to educate. You woke traitor. I will notify the DOJ about your illegal posts in this here privately owned forum. Cause I am a good son of the Fatherland. Heil Musk. Heil Trump.”

Greenman will be arguing it is the woke fault and Trump is misunderstood even if he watching the “woke” being thrown into ovens. He is in a cult.
