I heard about that as well, but many stores including Newegg and Allstarshop still continue to sell this version of the card. If anything, I can just return the card if it is not the correct one, but they assured me twice over the phone that is was the exact same as the pic and I also noted it...

I called the store before I ordered and they checked to make sure that the pic matches the item they shipped. I also mentioned it in the comments section of when I ordered it. But then again, you never know. I will let you know as soon as my card comes in.
I'm saving a couple of hundred because the latest hack can push it all the way to a 9800 as well. Also, as far as I know you can not damage your card in any way. If the mod is unsuccessful reinstall the stock drivers and everything should be fine.
You can softmod it with hacked drivers to a 9700 pro. The success rate has been near 50%, but to save a couple of hundred dollars it seems well worth the risk. The drivers are linked below along with an explanation of how it is possible.
