Well if its any consolation, I got totally screwed on the $299 10GB iPod deal last week. Both of my orders were cancelled.
They do have a warehouse in Queens, completely seperate from the Manhattan B&M, that they ship from so I don't know if I *really* got your Zen.
I think it was Gamespot where I read that they had reservations about the shoulder buttons based only on seeing the pictures. But, once they got it in their hands and played with it, it wasn't an issue.
If anyone has a problem with their ipod, why not buy a new one at a store with a no restocking fee/100% money back refund policy and return the broken one? Not ethical, but it gets the job done.
When I filed with the BBB online, I got a letter and phone call from them within a week. After they spoke to me, I heard from Macy's within a few more days and the whole thing was resolved in less than 2-3 weeks.
Major stores are eager to please their customers....when the BBB gets involved.
Get in touch with the NY Better Business Bureau! Once I got them involved with a problem I had with Macy's (they were telling me my GC was expired) and suddenly Macy's agreed to put the remaining balance back on my GC.
Try another Comp USA store
Dispute charge with credit card company (if you paid with one)
Try their corporate offices (I think they're in Dallas)
Contact local Better Business Bureau (this usually gets results for me)
Contact local government consumer affairs divison and/or state attorney...
