you could always rma the board if they have a newer revision. Otherwise put your agp to 4x. This should stabilize it. You can use smartgart in the ATI control panel with the newest drivers (3.0 & up) to set to 4x.

Its the catalyst drivers. The older ones would give you nearly twice the fps with UT than the 3.x series catalyst drivers do. Wouldn't worry about it too much.
it could possibly be a heat issue. Try cleaning off your cpu/hsf and reapplying the ol Arctic Silver. When I got my MSI I couldn't run my XP 1900 at 133mhz only at 100mhz. Turned out I wasn't getting good contact.

What kind of hsf do you have on the cpu? Are you using thermal paste or arctic silver compound? Its possible that your heatsink is not getting good contact with your cpu. Try cleaning it off and reapplying arctic silver (just a little bit) and see if that will stabilize your system.
You are using 98se I assume. If you are using the drivers that diamond put out, dump them and try the aureal a3d generic drivers. You can usually do a search for a3d and it will get sites that should still carry them. These drivers are about as up to date as you are gonna get for that card.
I've only had one problem with my ATI 9500Pro since I got it. It won't run with the new AGP via driver. As soon as I run it with the XP drivers all my problems cleared up. Now whether this is an ATI problem or a VIA problem is anybodies guess. I've spent some time over at the Rage3d forum...
Man, there is no doubt you got screwed. Even new a 9500 non pro goes for about $160 and the "special drivers" are free. If you paid via paypal or credit card contact them immediately and get them to get your money back. Then notify ebay that this idiot is selling an item under false pretenses.
First you have to get the flash utility and the modded bios. You can get these at 3dchipset.com. Next you have to create a boot disk (the flash utility must be done in dos). Put the flash utility and the bios on the boot disk.

Many times it is the memory, but if he's run memtest successfully on it then it might be time to look elsewhere. The best way to test memory is to try another strip, if you can get your hands on one.
Power won't be a problem with the 9700pro because it draws power straight from the PSU. You will get a definite boost using such a high power card but your ram/mobo will limit it somewhat.
