They wanted to draw blood to see if the victim was under the influence. No probable cause, no warrant, no consent.

The police have apologized and the offending officer has been suspended. This is appropriate thus far. A demotion or some other equally firm disciplinary action would be appropriate in this case. The officer's ignorance or perhaps disdain for the law is unacceptable.

Where did you see that he was suspended? The only thing that I read was that he was suspended from blood draw duty but was otherwise still on duty.


This situation is absolutely disgusting. I also wonder if they did eventually draw blood from the guy. I would hope that the rest of the hospital staff would stand united with the nurse and refuse him access to the patient but after seeing that it would be understandable if they just stood aside. The way the officer arrested the completely calm nurse was absurd too. He could have cuffed her right there instead of dragging her outside and pushing her against a wall, completely unnecessary. Even his partner had a kind of a WTF look on his face.

And imho the only reason they wanted a blood draw of the victim is to cover their own asses if the guy sues since he was injured as a result of a police chase. As has been pointed out many times, the cop even says that they didn't have probable cause. The entire line about "implied consent" was just what they came up with to cover their own asses. This guy was a trained phlebotomist and he was most definitely not confused by a law that hadn't been in effect for 10 freaking years not to mention the fact that he never once says anything about implied consent when the nurse and supervisor explain to him what is required for a blood draw.

I just watched a longer video of this incident. Looked to me like a few of the Officers weren't exactly comfortable with how this all played out. Of course they'll stand by their man but it was interesting to see their expressions.

This is where other cops can make a difference...but they probably won't do it. They need to call out the problem from within if real change is to occur. Otherwise, the mindset will stay in place because the cops know, for the most part, they can get away with shit like this.
