The judge who gave this sentance deserves far worse than this kid.
Mandatory minimum sentencing. Nothing the judge can do.

it wasn't consensual.
Yea it was. The girl initiated it too.
Fifteen-year-olds are not mentally equipped to consent.
not mentally equipped? so when exactly DO kids know right from wrong? i'm sorry, but anyone with a half decent conscience can tell what they are doing, especially in this case, is wrong in some sense, but you can always choose to (not) do something.

So what age would you pick? 14? 13? 12?

Is the law retarded? Yes.
Was he given plenty of opportunity to get off lightly? Yes.

I think about his case and the more I read about his case, the more I think prosecutors have a duty to make sure they don?t take cases to trial that they can win, when the punishment doesn?t fit the crime. Prosecutors have discretion, and they have to use it fairly and wisely.

You know how laws like this get passed? By "thinking of the children".

So you call up to 5 years of jail time, admitting to doing something wrong, and being registered as a sex offender "light"?
...he's in jail due to his own stubbornness.

Light is a relative term.
I don't necessarily blame him for rejecting the deal the first time around but when the prosecutor goes out of his way to offer the deal AFTER conviction a little common sense should come into play.
Don't get me wrong, I think he got screwed. But it could have been FAR easier for him. Specifically, he could have been out by now.
Thus my original statement:
...he's in jail due to his own stubbornness.

Are you kidding me? Consensual oral sex? 2 years apart? WTF? We are worried about stupid crap like this? The south is full of a bunch of sexually oppressed rednecks and the US, in general, is full of prudes.
It's ridiculous that this was even a law, let alone them convicting a person on it.

Is that a typo? Seems odd if not. So if she was 13 everything would be A-OK?Under Georgia law at the time, this was considered aggravated child molestation, a felony for teens less than three years apart to have oral sex.

Just ignore Viper. He's just bitter that no one would ever do anything consensual with him.
