Supply and Demand. It takes a willing buyer and a willing seller to complete the transaction. Its not like they are forcing you to purchase the card at that price. You are free to purchase from anywhere else or any other card.
This is BUSINESS.
If you think of it, Airlines do almost the same exact thing. Raise prices during holidays b/c demand is high. Reduce prices when schools open b/c demand drops.
Same thing with the Car industry. When new model comes out, prices on the newer model is high (high demand, low supply) but you can get that same vehicle for less few months down the road (low demand, higher supply).

Yes, AMEX has a 90 day return policy but they wont refund you the full purchase price. They wont refund you the Sales Tax (if you paid) and they wont refund the Shipping & Handling charges you paid. Also, you will have to pay for shipping the card back to them.
Even my card from CV/Newegg came in a white OEM back. Cables, manuals etc were in a ziplock bag and the actual card was in an unsealed anti-static bag with foam in it. On my card, even the sticker wasnt applied properly, it is slightly out of line with the heatsink.
Atacom is a real company. I have been to their warehouse in Fremont, CA (local pickup option) and they do keep decent amount of inventory and the people are nice. But I have dealth with them only once and I picked up in person, so cant comment on their shipping time. and I definately dont have any experience with their RMA.
Lately, I prefer ewiz (items that wont need RMA) but even they do price gauging sometimes. I get stuff from them the next day as compared to 2 days for newegg. But newegg's RMA policy is the best. Only other company that I have seen to provide a similar RMA service is mwave and Staples
EDIT: It seems like newegg/CV got a 2nd batch of these cards. Their first batch was a small one of about ~70 or so cards and that sold out within 2-3 hours of posting this deal. Please let us know if the newer batch also mods successfully.
So far, these cards have a 100% successful mod rate. But it wont be long till Sapphire starts using the actual chips (with non-working pipes) instead of the R480 core chips in the card. Companies will do this occasionally when they have more of the extra expensive cores and lesser of the cheaper cores but once they run out of the expensive cores, they start using the actual core that they were supposed to use. Remember the earlier versions of x800pro vivo cards or the first few batches of nvidia 6800 (non-gt) cards where most of the cards were modded successfully but the later ones didnt.
