Wow that's ridiculous. Isin't child porn considered child porn when the child is under a certain specific age? (16 I think?) How would one dictate the age of a fictional cartoon character that was made up on the spot? Or did he use known characters like Bart Simpson? You can go by looks, but if it's like a stick figure it's kinda hard to tell. Maybe it's an adult midget? lol

18, not 16. Child porn has nothing to do with the age of consent, which varies between 16 and 18 depending on the state.

I think there's also a provision that it has to be pornographic. There are some photographers who have taken non-sexual nude pictures of children and successfully defended themselves.

It is a bit troubling that they can go after you now for drawings, but I suppose it depends on the drawing. What about stick figures with a sign that declares them to be underage? What about drawn girls that look underage but are declared to be 18? I mean, with fictional characters, they have no age outside of what the creator decides.

It's a drawing. It's not a picture of something that actually took place. Essentially, based on this logic, if someone draws a picture that falls within the definition of stimulating it's a felony.

That's absolutely absurd to me, not matter what the rationale is for it. Note that it's not even trafficking or distribution. Simply drawing whatever sick fantasy you might have in your head can constitute a felony. That's messed up, much more messed up than the actual cartoons could ever be.

Missouri had nothing to do with this prosecution, which was undertaken by the federal government. The Supreme Court has more recently ruled that the federal prohibition against virtual child pornography is constitutional - I linked to the case earlier in this thread.

He acted on those thoughts, when he drew or obtained a copy of that drawing. While that doesn't necessarily rise to a criminal action, we should do what we can to be reasonably sure it never will.

That's what the psych eval is for - to find out whether he knows right from wrong, whether he understands the impact of acting on those thoughts has on others, especially children - via his drawings or actual criminal actions.

A southwest Missouri man will spend three years in prison for possessing cartoons showing child pornography.
A federal judge sentenced 36-year-old Christjan Bee of Monett on Monday to three years without parole, followed by five years of supervised probation.
Bee pleaded guilty last October to possession of an obscene image of the sexual abuse of children.
The Joplin Globe reports Bee's wife called police in August 2011 after finding what she believed to be child pornography on her husband's computer.
The U.S. attorney's office says in a news release that comics found on the computer found several images of minors engaged in sexual activity.

Let’s see. If you make a picture of an obscene image showing the sexual abuse of children, you can go to jail for 3 years. Hmmm….. I wonder if stick figures would count? I wonder if I need to start checking my kids art work to make sure none of them could be interpreted at sexual abuse pictures.
