Just to summarize here:

The OP sold a computer on eBay containing well over a thousand dollars worth of illegal software. He packaged it inadequately, shipped it via USPS without insurance, and in the process it was damaged.

The buyer initially indicated that the transaction was fine and left positive feedback for the OP. He later came back and stated that he wanted a full refund, then proceeded to ship back the computer with his own additional RAM accidentally installed before the details of a refund or compromise could be arranged.

Personally, I think both you and the buyer are idiots. You shouldn't be selling computers with illegal software and you should be ponying up the paltry insurance fee to cover your own ass. He shouldn't leave positive feedback then come back and say you screwed him over, and he shouldn't be shipping anything back before he's worked out a deal with you.

My advice is:
1. Take the computer back.
2. Take out his RAM and ship it back.
3. Refund him the cost of the computer plus your initial shipping costs minus the cost to ship back the RAM.
4. Stop selling things on eBay.

Microsoft isn't too happy with software pirates. I had some pity for you until I saw that you were giving him illegal software. Now I think someone should send the buyer a link to this thread so we can see what he has to say about this all.

Hey-

The computer was packed up today and sent back to you. I forgot to take out the additional RAM that I put in, so I will need two sticks back or re-imbursement for them. I went to the Egg place you recommended for pricing. I sent the computer the same way you did (USPS), but with much better packing. When you add to $638 I paid you the cost of two sticks of RAM, the new packaging materials, not to mention all the time I have spent on this, well- it was an expensive waste of time for me. Monetetarily, I will need to cost of the computer and shipping I paid- plus my shipping costs refunded. I can invoice you via Pay Pal, or you can just send me a payment via Pay Pal. This will need to happen soon, however. As noted, I will also need the two new sticks of RAM returned.

so i just got back from lunch with my gf,
and i havnt replied to the first 2 e-mails.
i just got the 3rd

The final for the refund is as follows. I paid 638.54 originally plus 43.20 for shipping it back to you (plus insurance). This comes to $681.74. If you opt to keep the two sticks of additional RAM, then you would need to add $87.49 to the total. The computer should arrive no latter then Saturday, thus I would expect payment no latter then Saturday as well. I certainly did everything I could on my end, but the operating system issue was the final straw for me. My hope is that we can peacefully resolve this matter, as you seem like a nice guy. An invoice will follow.

The software is legit, they are all mine, i just installed it for him, i made it clear to him that he wasnt getting the actual copies.

You didn't give him a copy of the software? Especially XP? What was he going to do in the event he needed to reinstall the software? Not to mention if you're installing xp on someone's computer, it should only be used on that computer. 1 license per copy.

now that i know that, its my mistkae... ill just take the computer back ... problem will be solved for the software at least... but thats not the main problem... i guess ill refund 583 like the other guy said.

Technically, his comments only show that he didn't send the physical CDs along with the computer. He never actually states that they were illegally obtained or unlicensed. Microsoft is not going to care.

Wow this thread has given me a headache. You guys were both wrong, I say you both chalk it up to experience, you refund him for computer and shipping one way, he pays for shipping the other way. That way you will both take more care on your next trade.

hmm now that i had time to think about this. i think you should refund every penny.

as others stated you sold a machine full of illegal software. the guy could have gotten in to a LOT of trouble.

Ultimately, the guy wouldn't have gotten into any trouble. It would've fallen onto the seller.
