No, in this case you have it the wrong way round, the federal constitution actually serves to prevent womens' rights being stepped on by the states.

Except these girls are underage and should have parental approval for any medical procedures. They are not of legal age for one, and two the older rapist could be pressuring them to "get rid of it" so-as to keep his butt out of the slammer.

This is a really touchy subject for abortion clinics, and other institutions that deal with minors caught in very adult situations - they're making an ethical judgement about the right to privacy, I really don't think it's as simple as 'they're breaking the law'.

While I agree that in some instances the law doesn't do a great job categorizing people (the 18 and 17 yr example is a good one), when the girl involved is only 13, I'm sorry, I feel it becomes an issue more important than a desire for privacy.

If I was in the situation of the PP counsellors, I guess my fear would be inadvertently making the girl's life situation worse by contacting authorites without the girl's blessing. Also, if the girl asked me frank questions about whether she or boyfriend would get in trouble with the law, and if there was anyway she could avoid that, I think I would give her an honest answer. I wouldn't necessarily advocate she take any particular course of action, but I certainly wouldn't lie to her.

Valid concerns, no doubt. The only thing I would contest is 1.) She's pregnant and 13, things can't get much worse than that. 2.) Boyfriend or not, there's no excuse for an adult to be having sex with a 13 year old. An 18yr old (or older) having sex with a 13 yr old? Ugh. If she's of the opinion she and her "boyfriend" can act like adults, well then owning up to responsibility like adults comes with the package. If I had taken that call, that's what I would have told her.
