9th Circuit: no 2nd Amendment right to concealed carry outside the home

And just like that, the 2016 election just got a lot more interesting. Not only has the rhetorical third rail been touched, the 9th court just did a belly flop onto it. If you were hoping that Hillary would cruise to victory with the aid of dispirited GOP voters your dream likely just got shot to hell (pun intended).

<snip>

On Thursday, the Ninth Circuit concluded that the Constitution does not grant citizens the right to carry concealed firearms outside the home. The decision, Peruta v. San Diego, is likely to be the last word on this litigation: It was issued en banc, meaning the plaintiffs’ only remaining hope is a Hail Mary appeal to the Supreme Court, which makes a habit of avoiding gun cases these days. Even if the justices did take the case, it’s difficult to see how they could justify reversing Thursday’s ruling: The majority’s 41-page decision lays out a compelling, comprehensive analysis that that even fervid defenders of the right to bear arms should have trouble dismissing.

Please be more scrupulous with the accuracy of your thread titles.

It is unlikely to be overturned. Not only is it in line with Heller, but the Supreme Court would likely end up in a 4-4 tie, leaving the ruling intact.

Yeah right, an authoritarian strongman will definitely let you keep your guns. I mean, he said so didn't he? And he never lies. Lol!

Not that it matters, I've been told that the moment any kind of gun restriction passes, the country will descend into civil war. The righteous, law-abiding (TM) gun owners with broad shoulders and strong jaw lines will take back the country from the feckless government ninnies. 2:35 ET... any moment now...

Win some, lose some.

Or is this a precursor, a trend of things to come?

Gun owners, are you afraid?

If so, the NRA suggest that you allay your fears by spending every single dollar and cent that you own, borrow or steal on the firearms of your dreams and stash them away for a rainy day.

And then when the next round of violations to your 2A rights come around as it surely will, the NRA suggest that you sell your children and house and spend all of that on even more and better firearms that enable you to kill things even better and faster than the stuff you already thought was the bee's knees.

Nah, just try'in to scare you fellow gun owners....because panic buying firearms and ammo is good for the economy.

based on slates logic, there was never a right to aboritions before the supreme court ruled, so therefor we should not have aboritions.

Hillary certainly isn't trusted by gun owners.

That was already known. So your logic is that this ruling will motivate people to vote for the guy that's going to take their guns away rather than the woman that will? Strange.

When has the supreme court ruled on this?

Even Scalia said that the right to bear arms is not unlimited.

Do you think that is what I'm saying? Quit trying to put words in my mouth.

Libs love to make assumptions and act as if those assumptions are simply fact.

They haven't. Heller pertains to the home.

Given the makeup of the court and the reluctance to hear gun cases the ruling will stand. The power to regulate the barriers to CC will still rest with each state.

Yay states's rights?

Presumably specified Constitutional Rights are not for the States to amend, alter, or infringe. This becomes hotly contested as more line items are thrown in under generic terms.

When it comes to bearing arms without infringement during travel and/or out in general public... I'm not versed enough to know the court history behind that. But this definitely places the issue front and center during an election year.

This ruling just keeps the status quo. It is absurd to think the 2nd amendment guarantees C&C for everyone, everywhere, no permit needed, which is what the counter ruling would have set up.
