I see typos and grammitical errors but no ebonics. 6000sux, do you even know what ebonics is?
btw I was just wondering something. If he is tailgating you, you two are going at about the same velocity. If you break-checked, you would slow down to about 5mph less than what you orignally started off with (making the difference in your two velocities 5mph - a fender bender at mos). However, you said this dude almost totalled your car, so that means two things: you are either one of the idiots who steps on the brakes once they get tapped, or you slowed down extremely fast (remember the distance between you two is probably less than 5 feet).
I don't read foreign languages. I am assuming it is Ebonics. Do you know what good English is? Your logic is flawed, and so is your ability to read. I said the dude actually did total my car. I did not slow down extremely fast; the person driving behind him stated that he hit the gas and accelerated into my bumper, another thing you missed. One person here stupidly accused me of having two accomplices travelling with me on the highway. It's hilarious.
1. I dont see any foreign languages being used in the quote by topweasel
2. The logic flows and therefore makes sense. You are probably using the wrong word when you were trying to make a retort.
3. "As a rule of thumb, impacting into another car is equivalent to impacting into a rigid surface (like a wall) at half of the speed. This means that rear-ending a still car while going at 30 mph is equivalent, in terms of forces, to impacting a wall at 15 mph. The same is true for the impacted vehicle."
MEANING he either had an extremely fast car, and/or your car was worth near to nothing in the first place, and/or you decelerated extremely fast as he accelerated into your butt, and/or you continued to apply the brakes once he hit you.
OR
The alleged tailgater wasn't tailgating at all but was just a non-attentive driver (this would make more sense with your story than what you have told us).
Remember that tailgating means that he was extremely close to your rear bumper.
You didn't say if you hit the brakes once he hit u from behind. That would obviously cause more damage to your car than if you
If there is anything else i missed, please fill me in (i dont recall all the details of your accident)
6000sux, just be glad you weren't driving a pinto.

While tailgating is pretty lame (I'm very guilty of speeding, I rarely drive below 90 on I-80 when I'm coming home from school and often top 100 when the traffic patterns permit) and I would rather slow down until an opportunity to pass presents itself, I've gotta say that you asshats who think you're hot stuff by "pumping the breaks" or more importantly you people who think it's cool to get rearended are absolutely insane. If you think tailgating is wrong, but it's ok to try to CAUSE AN ACCIDENT and potentially KILL someone - whether it be yourself, the tailgater, or someone nearby who had absolutely nothing to do with it, you're far more in the wrong than the asshat tailgating that you could have easily let pass. Put your egos aside, and let him pass.

Well said...I agree completely. No amount of road rage or tailgating warrants someone causing or risking an accident. I don't care if someone's on my bumper, flashing their lights, flipping me off, etc. I'm not going to slam on my brakes and risk killing someone.

You can spin this however you want to, but YOU caused that accident. Yes, the tailgater was in the wrong, but if you hadn't hit your brakes, most likely the accident would never have happened. You're lucky the guy didn't carry a gun...what you did is a major cause of road rage...you were at least 50% at fault in the accident, whether you got busted for it or not...

It's a good thing that your opinions don't shape the law, and never will. You can similarly repeat over and over that 2 + 2 = 5, but you will never succeed in convincing people who write textbooks. See, as long as you hold this wrong opinion, you are destined for failure in every argument; it's like arguing against gravity.

Thats your opinion...
I think he was 100% innocent... Anyone should be able to use the brakes at any time and you should be able to stop.... If you can't it's because you're following too closely. PERIOD. The law is explicit in this case for a reason.

You're going all incoherent again. Listen, we know your feelings, and we know that they are not in agreement with the way the law and insurance companies see things. Fair enough! Tailgate all you want, and it will catch up with you eventually. Then you will babble these things at the judge, and find out for yourself how reality works.

And what if a deer darts in front of the person you're following? Or what if they THINK they see a deer... or what if they feel as if they are not in as good control of the car as they feel the should be. What if they need to slow down to get oriented. What if they get ill... the list goes on and on and on and on. You have to be able to brake. EVEN on a highway...
So yes I can brake anywhere anytime I want including on a highway.
