AL: Pregnant Woman Shot Charged With Manslaughter

Pregnant woman, engages in an altercation with another woman over the baby’s father. In the ensuing fight the other woman fearing for her life shoots the pregnant woman in the stomach killing the baby. She’s acquitted and the mother is then charged with manslaughter since “she shouldn’t have started the altercation “.

So questions:
  • The shooter hit an innocent bystander (the fetus). Should she have been convicted of some crime? If so what? If not why not?
  • If the mother can be charged with manslaughter for starting the fight are there lesser crimes pregnant women in AL can be charged with while pregnant?
  • Are there actions that aren’t crimes for a woman that could become crimes for a pregnant women if this charge stands?

I’d think long and hard about living in AL.

1: One would presume killing the mother in self defense also kills the baby. On the basis of self defense, that certainly seems to be allowed.
2: Do I need to introduce you to Chemical Endangerment Laws?
3: If this charge stands? Attacking a person is a crime. It is also common for laws to charge a person with murder, if ANYONE is killed in the commission of said crimes. Irregardless of pregnancy. Irregardless of pregnancy, Alabama appears to be following the law here. However murky it may be.

Self defense is great unless it is a woman defending herself against another human living inside her and feeding off her.

I don't think you understood the sentence.

I think he's speaking to a branch of this subject that Paratus started when he stated:

It's a play on the idea of human rights for the unborn child. To question why it isn't a crime for the shooter if it somehow became a crime for the mother. And so we've wandered off a bit with some replies fixated on that aspect.

Anyways, I don't feel comfortable with charging the mother / victim / criminal with something more here. Her punishment was in losing her child, of being shot in the gut. I think that's enough here, from a moral standpoint. Even if the law allows Alabama to go further, I cannot help but think their actions here against this woman are wrong.

Looks like the unindented consequences of declaring a fetus with personhood. Same as stand your ground laws. Expect to see similiar ridiculousness in the future.
