From what I heard, the Alabama Supreme Court strongly rooted their decision in the State Constitution of Alabama, and not on a federal level, so a challenge in the SC is less likely and/or less likely to succeed.

Supremacy clause ... not saying this court would overrule it, just that it shouldn't be that unreasonable to find a way that it falls into that category for an unbiased legal mind.

Yeah except the scotus has already decided body autonomy is strictly up to the states.

Alabama's supreme court, in its infinite wisdom, has finally given us idiot's answer to the hypothetical question of "If you can only take one, which do you save in a burning fertility clinic: the baby or a tray of 1000 embryos?" It seems that they would tell us the embryos should take precedence, given that 1000 > 1.

They'll have to issue HVAC repair guys medical licenses now. 🤔

Yeah but I'd think that state laws cannot directly conflict with federal laws otherwise they are unconstitutional. This seems a direct conflict with constitutionally mandated US census law.

I'm pretty sure we have a whole slate of [blank] is treated as a person under the constitution for the purposes of [blank] style laws out there.

No reason we can't have a "[Fertilized Eggs] are treated as a person for the purposes of [determining whether a defendant has criminal or civil liability for their destruction]" as this court determined in this case.

My understanding of the read was that the the plaintiffs were suing to be compensated for the destruction of some of their fertilized eggs and the supreme court basically said "You cannot be paid for the wrongful death of a child, according to Alabama law/constitution since that is a criminal issue, not a civil one"

Since when have little things like that stopped this court?

We have a legal drug Mifepristone this court may invalidate. They have an agenda and reverse engineer the outcome.

Doesn't sound like what separation is intended for.
But I am no expert on how it is applied.

From the outside America is starting to look like the America in FarCry5!
We do have an awful lot of people in the GOP who are actively aiming to create a Christian theocracy, and aren't shy about admitting it  ̄\_(シ)_/ ̄
They're already adept at ignoring parts of the Bible, it's trivial to ignore parts of the Constitution too.
