so, my best friend is going through boyfriend drama right now (well, more like ex-boyfriend at this point)... guy is a total user, and we've been telling her for months, but she just never cared.

final straw was this month when her boyfriend's brother stole borrowed the car she'd been letting him use for the past year and ran up $100 in ezpass fees from driving back and forth between NYC ($11 each way crossing the Lincoln Tunnel during rush hour). actually the second time this has happened, but the boyfriend swore up and down after the first incident that he'd never let his brother borrow the car again.

she confronted him on Saturday, and after he continued to defend his brother, she blew up on him and finally broke it off. Sunday morning, she got a ride from another friend while the BF was asleep to take back the car, and she asked me to go with her tomorrow while the guy is at work to take back all her other stuff from inside the apartment (she brought her spare flatscreen tv over there, as well as most of the stuff in his kitchen)

odds on me getting arrested while stealing back her stuff? it's not actually B&E if she has a key, right?

Is she on the lease or otherwise living in the apartment? If it's her stuff, it shouldn't be a problem. I'd be more worried about getting your ass kicked. It's been a long time since I lived in NJ. Not sure if the police would be willing to assist, or at least follow you out there.

I'm not NJ lawyer enough to tell you whether she's a de facto tenant. I'd say don't steal any of his stuff in the process though Also, whether or not you could take him, it's probably bad news to get into a fight with the person who is definitely legally entitled to occupy the place. Depending on whose story gets believed there, that could put you in burglary territory.

99% sure... she's got questionable judgement about guys and she's a bit immature/naive, but I've never known her to be a liar.

Well, just remember, in some places being an accessory to the crime is the same as doing the crime itself. So if you get a whiff that she's ripping him off, better make it good and get yourself a watch or something.

Ya. Even if she's not "stealing", if the Ex shows up there's going to be Emotions and shit to make the situation tense. There might also be disagreements about who owns what, she said something obscure one time or he gave her something but he's pissed off and wants it back, etc.

Check NJ law to be sure. Under NC law she is a resident regardless of what the lease says and what your doing is fine as long as she can prove whatever she is taking is hers. For instance the TV would have to stay unless she has a receipt or other proof of purchase, it would be a civil matter. But state law can vary greatly so check NJ to cover your ass.

Not arrested yet, but this is the most awkward experience of my life.

Standing here as the silent muscle while my friend gathers her stuff and the ex-boyfriend's brother yells at us and threatens to change the locks.

Turns out that she *is* on the lease, though, so there's that.

That's not going to do very much once she has her shit though, is it? Is this requiring multiple car trips?

BTW, keep updating as things happen, this is interesting.

Edit: BTW, how old is this girl? Think she'd date a guy in Philly?

Shouldn't a 60" TV fit be able to fit between the back and front seats? Just use some linens as padding to keep it from whipping around.
