KIRBY, TEXAS –– Kirby police Tuesday said a man at home heard something unusual at his sliding glass door in the 2800 block of Von Braun Avenue around noon.

"That caused him to go to investigate," Kirby police Chief Kevin Bois said. "He saw at least two people trying to make entry into the home."

Bois said the man did not want to be a victim of burglary like he was two years ago, so he grabbed his 9 mm handgun.

"(An) armed homeowner (was) ready to defend his property and that's just what he did," Bois said. "So unfortunately we had a tragic outcome."

Bois said the resident shot and killed an unidentified 17-year-old man. Another teen was also shot and underwent surgery at Brook Army Medical Center. Police apprehended the third teen who they say acted as a getaway driver.

Bois said Kirby has had only had four homicides since 1987. Because they handle so few of these types of crimes, asked the Texas Rangers to lend their assistance and expertise with the investigation.

Louis McHaskell lives next to where the shooting happened and heard the shots. He said he then saw his neighbor with a gun.

"He was so pumped up he fell into my arms and I took the gun away from him, secured it in my house, and called 911," McHaskell said.

McHaskell said the incident should send a message to would-be criminals.

"The people out there waiting for us and breaking into our homes are going to have to understand they're going to face what may be the ultimate," he said.

Bois said the homeowner who fired the weapon probably won't face charges because he acted in self-defense.

Oddly worded. Almost like the assumption is that what happened here was a crime, rather than a homeowner protecting himself and his property.

Homicide != murder

Homicide (Latin homicidium, homo human being + caedere to cut, kill) refers to the act of a human killing a human being

This is what the guy did, and he had every right to according to the law.

Even if it is seemingly done in self defense, it is investigated because there was a fatality.

so if only 4 people have been killed since 1987, that must either be a really small town or VERY peaceful

Since the local police needed to ask for help due to the rarity of the "crime", perhaps the paper should have phoned in some journalism help from a larger news organization in writing the article!

I've read about several different stories this year about criminals being killed trying to commit robberies in Texas. So how many criminals have been killed in your state recently?
Well, Virginia is infested with illegal aliens so I would have to say: Not nearly enough.
The funny thing is they have been getting treated like American citizens for the past few years, so its not likely the problem will ever have any solution.

There's been dozens in my state, these stories hardly ever make the news though. Some 17 year old got shot and killed trying to enter a home just a few weeks ago.

Word to criminals - you have a good likelyhood of dieing by entering.

While I've never been for guns being free to all, this is one instance where it was properly used for good. They tried to break in, they deserved what they got. Too bad they were not all killed. The others will be in jail for a few months then back to robbing houses again.

Hopefully the home owner does not actually get charged for homocide, that was self defense and I probably would have done the same gun or no gun.

Negative. The other two will most likely be charged with murder. Even though they didn't pull the trigger they can still be tried and convicted for murder.

Texas has castle laws which prevent the property owner from even being charged or held liable in civil court.

Well they got what they deserved, but in nearly everyone of these stories, you'll see in the article or on comments on the story

"Well, this will be a lesson to future criminals...yadda yadda"

The fuck it will. If it was, then home invasions / armed robbery would be a thing of the past.

If you're main source of income is stealing shit, chances are you don't read or watch the news.

The rule of felony murder is a legal doctrine in some common law jurisdictions that broadens the crime of murder in two ways. First, when an offender kills accidentally or without specific intent to kill in the course of an applicable felony, what might have been manslaughter is escalated to murder. Second, it makes any participant in such a felony criminally liable for any deaths that occur during or in furtherance of that felony.

Where did you get that CSI? If no one is home it's burglary of a habitation. If some one is home it becomes aggravated burglary of a habitation. Aggravated crimes are served day for day 99% of the time.
