This is his complaint to paypal:

Seller has become rude, abusive and nasty in her emails. She is also very evasive as to when the phone will be shipped. I told her I need it ASAP and she responded with a very nasty email. I WILL NOT to bsuiness with someone like this. Yes, I owe her for a PayPal charge but was trying to get a straight answer about when the phone would be shipped first ... I could not get any kind of "solid" answer from her as she is very evasive. Below is an example of her latest and greatest email to me: -Maybe you didn't understand me previously and I hope you'll read these words carefully so that you'll understand. As of right now, you still owe me $6.07. I will NOT ship the phone, until you pay me that amount of money. Damn, if you don't understand that, I don't know what will make you. Here: No money, no phone. Okay?- I repeatedly told her I was going to pay this charge but wanted to know for sure when it was going to be shipped and still ... she remained EVASIVE. She is also trying to tag me for an extra $25.00 in shipping fees (now that she is mad) when she clearly states in the auction that shipping is free. This transaction is over and dead and CANNOT be resurrected. I need PayPal to chargeback the money to my account and end this. It is done as I will NEVER to business with this person. It's finished. I have perfect feedback and I need to get my money back and move on.


I never charged me $25.00 for shipping. He owes me $6.07 for paypal fees and I have the right to hold on to the phone until he sends me MY money. Am I right?

Looks to me like you're in the wrong here. Paypal fees are a part of the game. If you don't want to be charged fees, use a personal Paypal account.

regardless of if you mention it or not, i don't think you can charge a buyer extra for the paypal fees. You could tack it onto shipping prior to the auction, but i don't think you can say you're adding that for the shipping/handling fees.

I also am thinking that you are in the wrong, albiet your buyer doesn't seem to understand the concept of communication.

Just because you mention something, doesn't make it right. That said, the buyer should never have bid on your auction if he/she had no intention of paying the fees. I'd cut your losses, send the phone, and move on.

What you did was violate ebay policy as well as paypal policy. This could result in both accounts being locked, plus any pending transaction is considered void; if you issue negative feedback, your violations have grounds for feedback removal upon request of the buyer.

The buyer knows you aren't allowed to charge extra for PayPal, so ebay will be on the buyer's side. It doesn't matter whether you say it in your auction or not. Ebay does not allow you to require buyers to pay the PayPal fees.

According to ebay rules, you are wrong.

Yup, the buyer should probably not have bid without contacting you, but even now as the winner of the auction they have no obligation to pay fees which are against both Paypal's and eBay's terms of service. Its your problem that you don't know what you can and cannot charge for. Eat the loss, ship the phone, and then never ask the buyer to pay those fee's, or you'll end up without a paypal account.

When you're Title says "Another ebay asshole" I think you're referring to yourself.

Read the TOS on paypal. You're not allowed to charge additional fees on accepting paypal.

The buyer is in the right

Judging by the writing, you're both acting like children; however, you're the one who is wrong:

Charging extra based on payment method: Wrong, against seller policy.
Ambigous answers about the ship date, ie, "trying" to ship Wednesday, "might" ship tomorrow: Unprofessional.
Slow shipping, ie, not the same or very next business day after payment received: Also unprofessional.
Condescending replies, ie, "read these words carefully so that you'll understand.": Beyond unprofessional; it's childish and rude.

You're not allowed to charge extra based on how somebody pays. Clear it up with Paypal, send an apology, a positive feedback, and ship the phone TODAY. Don't be wishy-washy about shipping. "I'll try to ship the phone on Wednesday" is not a clear answer.

EDIT: Oops! I see that he doesn't wan't it anymore. (I would be nervous after "might," "try," and "read these words carefully so that you'll understand" too.) Maybe you should go ahead and tell Paypal to issue the chargeback. Don't fight it at this point, because as we say sometimes, you're "pwned" in this case.

I'd be proactive, and issue a positive feedback anyway, and apologize for being unprofessional. Tell him that you understand now how and why you were wrong, yadda yadda, and "thanks for the learning experience." It's the best way I see to avoid a negative feedback.

be able to ship out the phone tomorrow" and the "I will try to ship out the phone on Wednesday."

Sounded like even if you did receive the money, you may not have an opportunity to ship it. That's all they wanted to know in their first reply to you.

They shouldn't have complained at the smallest sign of rudeness and you shouldn't have been evasive. That's how I see it. If you were clear on your end from the start then maybe they would not be able to squirm their way around your "pay me now" request.
