PayPal's policy:

No Surcharges. Under Visa, MasterCard, Discover and American Express regulations and the laws of several states, including California, merchants may not charge a fee to the buyer for accepting credit card payments (often called a "surcharge"). You agree that you will not impose a surcharge or any other fee for accepting PayPal as payment. This restriction does not prevent you from imposing a handling fee in connection with the sale of goods or services, as long as the handling fee does not operate as a surcharge (in other words, the handling fee for transactions paid through PayPal may not be higher than the handling fee for transactions paid through other payment methods).

eBay's policy:

Payment: Surcharges
Sellers may not charge eBay buyers an additional fee for their use of ordinary forms of payment, including acceptance of checks, money orders, electronic transfers or credit cards. Such costs should be built into the price of the item-this policy reduces the potential for confusion among bidders about the true cost of an item. Further, some forms of payment surcharges, such as credit card surcharges, are forbidden under the laws of many states, including California.

You're not allowed to charge extra based on how somebody pays. Clear it up with Paypal, send an apology, a positive feedback, and ship the phone TODAY. Don't be wishy-washy about shipping. "I'll try to ship the phone on Wednesday" is not a clear answer.

EDIT: Oops! I see that he doesn't wan't it anymore. (I would be nervous after "might," "try," and "read these words carefully so that you'll understand" too.) Maybe you should go ahead and tell Paypal to issue the chargeback. Don't fight it at this point, because as we say sometimes, you're "pwned" in this case.

I'd be proactive, and issue a positive feedback anyway, and apologize for being unprofessional. Tell him that you understand now how and why you were wrong, yadda yadda, and "thanks for the learning experience." It's the best way I see to avoid a negative feedback.

What's wrong with paying more for pay-pal. I state the option to send via money order. Fine, jsut don't pay via-pay-pal.

fees, I REALLY hate people who charge paypal fees and never bid on their crap. You almost as bad as those who carge insane shipping prices.

ya right. Selling something for $1,000. Screw that. Charge $900 for the shipping with a $1 opening bid. Do you know how much you loose in commissions sometimes!

I'm sorry but i would have never bid if you have to pay your paypal fee's.

So you want the buyer to pay the price, the shipping and paypal fee's no way!

part of using the paypal service is that sellers have to pay a fee for using that, not buyers.

If you list Paypal as an acceptable form of payment on your auction, and then you tell me to pay your Paypal fees associated with making a payment to you, I would file a complaint as well with Ebay.

Ebay owns Paypal, so the person charging the fees for using Paypal will lose everytime.

Personally, I'd bid on your auction and refuse to pay the paypal fee. It's for your convenience too - if I use paypal, you get the money sooner than if I pay by check. If there are 10 of an item on ebay, I won't bother bidding for someone who includes "paypal fee" in their listing. But, if there's only one choice, I'm going to wait until I win the auction before I open that can of worms.

But, I'd send a polite email saying "here is the shipping fee, here is the money for the purchase - note, I did not include the paypal fee since you agreed not to charge it." Upon the response "I never agreed" I'll respond back with a "you certainly did, when you agreed to the TOS on ebay."

edit: can of worms, not can of beans.

extra paypal "fee" charges are not allowed here also.

I have bought and sold stuff at ebay,i charged a minor "packing handling fee"

Will ship only to lower 48 states.Buyer to pay actual shipping costs,plus $ 2.00 packing fee,to cover cost of bubble wrap,etc. Or if you are near me you can pickup in person.

Would you return to this thread if you were blasted by 50 members of ATOT? Clearly, the seller of the phone has wasted well of $6.00 of their time by fighting with the buyer of the phone and also wasting their time to whine about the issue by creating this thread.

thats the problem with many ebay sellers. they think there a doing the world a service by selling stuff online. what they fail to realize is that they are just like any other brick and mortar business that try to get good customer service and try everything to please the customer. imagine going to wal-mart and an employee gave you that attitude...

what the seller did is basically the same thing if you were to go to a grocery store and there is a sign at the entrance saying, "if you plan to pay by credit card, then be prepared to pay our credit card fees." sure it's convenient to the buyers to use paypal, but sellers must be fvcking dumbasses to not realize that paypal benefits them as well. many people will buy from them just because they are able to use paypal. if i were to go on ebay and i see 5 auctions selling the same thing at the same price, but only one of them accepts paypal, i would most likely go to the seller offering paypal (all else being equal). that reason is the main reason why MOST business accept cc's, despite the cc fees. the profit from accepting cc's with the cc fees far outweigh the business not received from not accepting cc's. if you dont agree with this, then ask yourself how many times have you passed up going to a restaurant because they did not accept cc's, and that was your only form of payment.

i am not going to jump on the bandwagon by calling the seller a dumbass or anything, but the seller should really consider having better customer service in the future when making a transaction on ebay. i sure as hell would not return to any business that gave me the attitude that the OP did, even if i was wrong.
