I have a friend who's been here since middle school (she's been in the US for 17 years now). Her Dad owns a home here in California, and he is on track for citizenship. She has literally 3 degrees (2 grad degrees), and is still forced to go to school. She's a RN. She can't work or she'll be deported. Her older sister is a US citizen (born here). Her older sister couldn't apply for some sibling citizenship soon enough (takes 12 years, and can only apply to have your siblings get green cards after you're 21.. Friend has about 7 more years of wait to go).

So now, she's getting super depressed because she can't work. She's forced to go to the local CC just to stay here in the US. She had an awesome job @ UCLA, but she can't work there anymore. UCLA is sponsoring her, but the process takes 5 years (that means at least 5 years to get a green card, until she can work again).

I don't get it...

EDIT:
She did apply for permanent residence, and UCLA did it for her as well. She can't apply with her dad, and h1b does not apply in California.

oh well.. I guess this just turned into a rant thread. I suppose she'll just have to wait 5 years before she can work again.

Locked at OP's request.

you mean she can't get a H1B visa? company can always go with the H1B route....I don't know why it wouldn't work in her case.

US gov't doesn't give a sh!t about level of her education.

Oh crap I feel stupid today. Why didn't she apply for permanent residence at the same time as her father? What sort of visa does she have?

owning a home doesn't mean sh!t either. If the father is on track for citizenship, so he has a green card?

doing family reunion to get somone in US will take a very long time. Do you know that there is a difference between permanent resident and citizenship in US immigration?

I don't know how H1B does not apply in calif. i actually have friends that work in Cali on H1B. if that is the case, your friend will have to broader her horizon and move to a state that will sponsor H1B for her.

She can always marry a US citizen and get a citizenship that way.

There are tons of Californians on H1B visas. California companies extensively lobby for increases in H1B visas.

Maybe her profession doesn't qualify for it?

So I take it that by the time her dad applied she was not under 18. I'm no expert regarding this subject but it seems she is screwed.

A thought: If H1B does not apply in California, then can she go out of state to apply for H1B?

If she can't do it properly, GTFO. Get a work visa or get married or GTFO. It doesn't matter how much of an upstanding citizen you are. If she's such a great person, she'd set a damn example instead of breaking the fucking law.

I have never met an illegal who didn't have a sob story. If she's illegal, she should get out and get in line of the other ten million people who are doing it right.
