Are there points involved for getting a ticket for expired insurance?

I apparently was speeding (60 mph in a 35 mph) and got stopped at about 1am.

I was driving my dad's car (he left it here before he went on vacation). He has valid and current insurance on it, but the only card that was in the glove compartment expired about two weeks ago.

Cop said he'd go easy on me, nothing for speeding but a ticket for not having a valid insurance card in the car. He said there's no points involved, but I txt'd a friend and she calls me up telling me she thinks there's points involved...

This sucks.

In Vermont you have 48 hours to provide proof of a valid license and insurance. Doesn't matter if it's not right in the car, you can bring it to the station later and have the ticket dropped.

Depends on the state. Some will suspend your license until you acquire insurance and then force you to SR-22 for a year.

Many states will drop the no insurance ticket if you can bring proof that the car was in fact insured at the time of the ticket. You may pay a court fee, but the ticket would go away.

Each state has different laws. Some states it isn't a point violation, others it maybe. Call your local DMV up and ask them.

Also insurance companies don't look at points, they look at what the violation actually was.

Just called my local court up (in NJ), was told there's no points but a $180 fine. I might not be able to fight it because of work, but if I can get out of work (i'm trying to get some days off approved anyway) i'll definitely try to fight it

I imagine if you can produce documents showing that the car was actually insured, you won't be in much trouble.

AAA does.

no proof of insurance are fix-it tickets. In California you take a current proof of insurance form to the DMV along with your ticket. You pay a $10 processing fee, and the violation is fixed.

One of my former insurance agents would 'back date' auto insurance coverage. You're magically insured at the time of your citation.

mail
get court date
show up with valid insurance card (assuming u indeed had insurance at that time and just couldnt find the card)
go to court
procecutor tells u to go home

So, you take the word of your friend over a cop, and then don't use Google to check state laws, and then don't call your insurance agent and ask?

This is the second time this comment has been posted. I don't mean to sound like an ass, but using simple logic, if I fully trusted my friend, would I post the question here soon after?

I guess, inversely, you can say simple logic dictates that if I speed I may be reprimanded. And if that's what you were going to say, fvck off.

Weird... in most states you just need to be able to produce proof in a certain timeframe. I STRONGLY suggest calling your local Pig Department and finding out what the law is in your state.

The sad reality of life is that you can't believe everything an officer tells you. Sometimes he's on a power trip, sometimes he simply doesn't know the law (his job) very well. Call your local pig pasture and ask them about the laws in your state. If you provide proof within the timeframe you may be able to have the ticket removed.

Oh, and I think you only get points for moving violations with few exceptions, but don't quote me on that.

I may be wrong here, but I believe they could still give you the speeding ticket if they want... something to keep in mind if you decide to waste the officer's time by contesting the ticket after he was a nice guy by letting you off with a no-point violation. I believe something similar happened to bmacd, he tried to use a lawyer to plea bargain after the cop let him off easy, and the response was that they could still charge him with the other violations.

That's a good point... since the cop let you off on the speeding, I'd let this one go... ESPECIALLY since you were doing 60 in a 35, which is just insane BTW. I generally don't believe in the rediculous limits set by the state, but I can't think of a single 35 in my area that you could safely pull 60 in. In my state, 20mph over the limit is reckless op and grounds for license suspension...

Uh... no. I imagine this varies by state, but police have a very limited timeframe to file infractions (like speeding) against drivers, usually 2 weeks. Speeding is not an actual crime, it's a traffic infraction, with entirely different rules. The officer either did witness the infraction and wrote a ticket in a timely fashion, or he did not. He can't come back 2 months later at the hearing and issue a ticket then because he didn't like the outcome of what he actually did choose issue at the scene. Exactly what excuse will the officer have for the judge as to why he didn't issue the ticket at the scene as the law directed him to do?

Go to court and when they dismiss the insurance ordeal, get in the cop's face with your arms flailing about

"BOOYA SUCKA! SHOULDA GIVEN ME THE OTHA!"

Of course, you'll never get a warning again... but let's work with the 'now', shall we?
