Argh. Lied to by a seller on eBay....

Item advertised 'BRAND NEW - SEALED IN BOX'. Item arrives, its clearly been opened, packaging is ripped, the seal has been cut, the item wasn't put back in properly and had been flopping around inside (The packaging is clear so I can see inside). It even has the Best Buy License Tag on the bottom, so its obviously a store return.

Haven't taken the item out to test yet as I'm waiting to hear back from the seller (he has good feedback, so we'll see), but he clearly lied on this one.

eBay has gone downhill so much this year its depressing

Although eBay has been ass for quite a while, I wouldn't consider this or most other dbag seller incidents their (eBay's) fault, unless they're (dbag sellers) repeat offenders or something.

Well I've had issues with eBay as a seller for a few months, but now its even hitting me on the buyer side. Its disappointing. I wasn't blaming eBay specifically for this, but just trying to imply how bad things on eBay have become.

If it weren't something that goes into your body, I would tell you to get over it. But who knows what kind of ear bugs the person who tried that thing before you had.

This is what I was going to say. If you get burned by a seller the entire store sucks? We have scammers come through AT here, does that me the FS forums here suck too?

Look at the listing and you will see a picture of the contents of the box outside of and on the box. How could anyone not realize it had been opened after seeing that pic?

He had used that pic before in previous auctions and was selling 8 of them. I had every reason to believe it was new/sealed based on his description.

Just an update as well, just got off the phone with the seller, i'm sending it back today for a full refund. He promised to cover return shipping, but we'll see if that happens.

I guess there's the remote possibility that it's an honest mistake, that the wrong box was shipped to you. In that case if he reimburses everything it's OK.

Of course that's why you don't pay for anything with Paypal, or you're essentially up the creek in such a situation. All he'd have to do is show the receipt for shipping you the item and you'd lose.
