In the OP it says "kids" were between 12 and 15. Meh. I can't count the number of times in my early youth there would be half a dozen of us riding in the back of a pickup truck on the highway and rarely anyone raised an eye.

It's not like he had freaking toddlers bouncing around in a back seat. Some of these "kids" are close to driving on their own.

I'd maybe lawyer up and see if he can dicker down the points/penaties. Probably going to cost more though.

2) Check the ticket carefully - often the cop will write down the wrong date, time, law, or whatever. Could be grounds to have the ticket dismissed.
3) Prepare to call the cop as a witness and have lengthy questions ready.
4) If there were any adults in the car, bring them as witnesses
5) Prepare to appeal when you lose.

The difference is that speeding is not dangerous at all but riding with no seatbelt is the most dangerous thing evar.

It's an interesting outlook on society. My Dad was one of 7 kids. My grandma would actually wrap the infants up in blankets and place them on the floorboards while the older kids got the seats (no fancy seat belts/harnesses/5 point roll cage booster seat/ect).

Now we have people saying that kids need to be in rear facing seats until they are 2 years old and in a booster until they are 12.

Saftey is fine...but it's not a replacement for common sense. I guarantee that my grandma drove better with a kid rolling around on the floorboard than some idiot in an an SUV with a kid in a 5 point recarro carseat in the backseat weaving all over the place while talking on a cell phone and drinking a starbucks.

I can't help you, but that does suck. Unfortunately that's the society nowadays. Even 20 years ago we rode in the back of the station wagon and crawled and played around in the backseat with the back window wide open. We didn't wear seatbelts anywhere and nobody really cared. Now it's like you kid has to be 12 years old and 65 pounds or something before they don't need a booster. It's just the way it is.

If there's a chance of getting the tickets voided, I'd do it because having those tickets costs you more in insurance. But in this case, I think the OP is fucked!

I can't speak for other companies and am speaking of the experience I have with the states I have been an underwriter for (which is the eastern half of the US primarily), and points are not looked at on their own.

We look at minor and major violations, accidents, and active moving suspensions (DUI/DWI/driving without license/etc). Minors are just speeding for example, majors are DUI/DWI/etc, and if your license is suspended due to DUI/DWI/etc then we count that stuff. Generally things like non-moving violations (suspensions due to failure to pay child support, seat belt, etc) are not counted. My company doesn't look at points, at least in the states I underwrite for.

Fines are minor issues compared to the points associated with the tickets. If he can commute the violation to some other violation that does not involve points, I could that as a big win.

Total junk! The Government has no right to tell me to wear a seatbelt or do anything else in my car. It's not hurting anyone outside of myself. This is not like texting or drinking or smoking drugs. Those all have potential to hurt other people not in the owners car. This is nothing but a Government trap and people here condone it.

ok. Thanx for the explanation. Over here seatbelt is considered moving violation. Over here it's 2 demerit points and 90 dollar fine per instance. Apparently we are supposed to wear seatbelts in taxis.

I fell out of the back of my aunts moving station wagon when I was a toddler, (it was in a parking lot, she had neglected to fully latch the rear gate. Probably not the best endorsement for how things "used to be", but anyway...) and used to stand on the passenger seat while my dad drove the 1971 AMC Javelin.

On the other side of that coin though, I wouldn't even *think* about driving somewhere without each of my 4 kids properly secured in the vehicle.

To the OP...Mercy of the court is probably your best bet.

Yes, this fine and such is way overboard for the "offense". Of course you will have someone always say, "WELL WHAT IF XXXX!!!!! $100,000,000 FINE AND 10,000 YEARS IN JAIL!!!!!"

Back in the 70s and early 80s, I rode in cars stuffed with kids (I being one of them). If we did get pulled over (we never did) it wouldnt have been more than a REASONABLE fine of $50 or so.

Unfortunately, reason no longer applies in our society.

I started driving before seatbelt laws and almost never wore one if I could get away with it. It irritated my stomach.

These days cars wont STFU unless you wear one. :'(
