Yes, this fine and such is way overboard for the "offense". Of course you will have someone always say, "WELL WHAT IF XXXX!!!!! $100,000,000 FINE AND 10,000 YEARS IN JAIL!!!!!"

Back in the 70s and early 80s, I rode in cars stuffed with kids (I being one of them). If we did get pulled over (we never did) it wouldnt have been more than a REASONABLE fine of $50 or so.

Unfortunately, reason no longer applies in our society.

Difference is back then your parents probably would not sue the driver if he drove a little fast going over the speed bump and you hit your noggin against the windshield.

In CA seatbelts are required for all parties in the vehicle at all times. If all passengers are <16 the driver is vicariously liable for all of their violations unless one of their parents is in the car, in which case the parent is liable even if not the driver. Anyone 16+ is liable for their own violation.

In CA a seatbelt violation is a primary offense, meaning there does not need to be any other reason to be stopped. More than likely the CHP officer saw 4 heads in the back seat of a coupe/sedan and knew at least one wasn't buckled in.

IIRC seatbelt violations in CA are considered moving violations, which is why I think his insurer is going to screw him. CA takes seatbelt laws very seriously. If OP has SF it would be 4 minors = 2 majors = auto non-renew. When another carrier ran his ChoicePoint report (or whatever service they use) they'd see 4 citations at once. In fact, the CADMV even says "If you have points your insurance will go up".

Of course, with 4 points OP could get a suspension/revocation of his license so insurance may not matter now anyway.

Does anyone else remember the days when you used to ride around in a truck bed? For fun? Yeah I'm sure it wasn't safe but times did seem to be a lot more simple when I was growing up.

Hell yeah. Remember sitting in the truck bed while the parents were driving down the street at 40 MPH. Crazy fun for a kid.

The way I'm picturing it in my head, one kid has most of the shoulder, all of the lap belt. The other kid gets the bottom part of the shoulder, and has the lap belt. The kid with the shoulder belt would be ok and restrained, but the kid that got the short end of the shoulder belt would be thrown forward (and hopefully not out of the seat) in a serious rear-end collision.

Look, I live in California, and I have a rule that your seat belt better be on before my car starts moving. I also refuse to transport more people than I have seat belts for in the car. I KNOW what the laws are in this state regarding seat belts and that it is a primary offense, and I don't want to be screwed over with the fines, penalties, and corresponding increase in insurance. I do NOT enjoy being pulled over by the cops and I drive very tamely to avoid these occurrences.

The actual fine is probably less than half of the total cost per ticket. It's all the fees that the courts, state, and county imposes on top of a ticket that makes it crazy. Blame that on the broke-assedness of CA.

This is a state that uses the Amber Alert signs to flash "Click it or Ticket" warnings. Everyone here in CA should know better. If you don't, just be prepared to lawyer up or pay.

Yep, as I posted last night, the actual fine for a first offense seat belt violation is only $100 per incident. The rest is "penalty assessments."

One of my favorite memories as a kid is riding in the bed of my dad's pickup truck. He only let us do it a few times, and he would go real slow, but we would just lie on our backs and watch the tree branches go by. :thumbsup:

ZERO TOLERANCE. Anyone with kids in the car deserves the death penalty.

What's weird is that it's parents attacking other parents. People who don't have kids or people who already have grown up kids don't really give a shit. The people most likely to get fucked by kids in seatbelt laws are the ones most strongly behind it :awe:

When there are 4 people sitting in a seat made for 3 with a finite width and unmoveable seatbelt points, it would be very difficult to buckle 3 of the 4.

I sure do, and I also remember one of my older brother's friends was driving, and his buddy was messing around in the back and ended up dead on the pavement. That really screwed up the driver for a long time.
