Could the seller use a collection agency to collect money from this buyer?

I wouldn't worry much about this. The seller is going to get his ARSE nailed if the buyer really wants to. I remember reading a guy on ebay who did the same thing, but it was a "picture of 42inch plasma TV". Some moron paid like 1K and got a picture of a plasma. Sure enough he went to the police and the seller got nailed even though the auction clearly said the winner would only get a picture. The seller was found guilty and got his arse served

Found guilty of what? Links?

Don't even try to tell me that the seller who put up a reserve price auction for a worthless box with $500 buy it now price (plus $10 shipping!) had honest intentions. There's no argument that could possibly convince me that this jerk-ass seller is on the up-and-up.

BTW, I reported the seller to eBay several hours ago, just in case (though unlikely) nobody else had yet.

you guys are fvcking idiots. i hope all of you get cancer in your penis and they have to chop it off. who cares if this is illegal or legal? the fact is that he is trying to scam people. you know damn well no one would buy a box if they knew thats what it was. sure, the buyer should have known the terminology, but what if you wanted something and you were not up-to-date on the lingo that goes with it? would you expect to always get ripped a new one? no, or course not. dont give me BS like "i do 5 hours of homework before i buy stuff" or "my friend has one so i know what i am talking about." i cant believe you people think this is ok simply because it is thoroughly explained. that doesnt make it right...some people just arent as intelligent as others, and that sure as hell gives you no right to take advantage of them.

edit: spelling

Granted that he is legally selling a box, but his description is misleading. He purposely listed the specs for the iBook which is only what is printed on the box, and people that doesn't read quite well will overlook the fact that this is a box that they're buying.

If you have an ounce of integrity and dignity, you would not forgive this weasel for purposely trying to scam people out of hundreds of dollars for something that's worth a dime. For those that say he's legit, I do hope it is your family members who are purchasing this box.

Well atleast there are still some decent people in the world instead of asshole armchair lawyers thinking it's cool to make a quick (500) buck off someone else.

sxr7171, it should be enough for you to understand that anyone in our court of law will find this immoral. and if they dont, they shouldnt be in that position. who gives a sh!t if they broke a law...there isnt a law for everything. there isnt a law that says i cant sell ecoli infested cans of soup, but i bet they might find that to be immoral and i would go to jail. just because it isnt explicitly stated as illegal does not mean people should abuse the exploits in the system. they should either be banned or exterminated.

You can't send a guy to jail over this. The best you can do is nullify the contract and have the guy make civil reparations. It is true that a judge or jury would allow for reparations since you are right that there isn't a law for everything and existing laws are subject to interpretation. There is the concept of the "spirit of the law." I doubt they would really impose criminal penalties on the guy unless he repeatedly does it. Still you have to understand that it is pretty clearly written that it is a "box only." This is the sort of thing that should teach people to read what they agree to. It encourages personal responsibility for peoples' decisions, whether it means sticking to the terms of a contract or understanding that returning an extended warranty means having to deal with the manufacturer in case of failure.

Auctions for boxes should be allowed in a community where almost anything can be traded. The seller listed this under the category: "Computers & Networking > Apple, Macintosh Computers > Other." He did not list it under laptop computers. He lists that it is a box in the title. He says it's a "box only" in the description. However there is no doubt that the listing is deceptive since no one lists the specs of the computer that used to be inside the box when selling an empty box. I think he's an a$$hole for doing this, but people still need to learn to be more careful and take responsibilty for what they agree to. Just buying from a seller with low feedback indicates accepting a risk. Refusing the collision damage waiver when renting a car puts you a risk which you accept when you refuse coverage, similarly there's great risk in buying an expensive item from a low feedback seller.
