All our bills are done via the banking bill pay system. I then have evidence as to when the bill was paid and the system has a log of when it was received. As to when they (receiver) chooses to post it; that becomes their headache if they try to slap late fees on me. I have the evidence that the funds were in their possession.

I been doing the same. it has saved me once on my CC payment.


Ah the good old days. I used to have these problems, but don't any more. Is it because I make more money? NOPE! Is it because the pain made me wise? YUP!

I watched my sisters do stupid shit growing up. I learned CC's could lead you into a LOT of trouble.

I still made mistakes. but nothing that hurt me for life.

The life/credit ignorance here is expected.....coming from the place where "just pay cash or you shouldn't buy it" is actually a theory treated as legitimate.

until i was about 38 i fell into the "just pay cash" catagory. only thing i ever had in credit was my home and occasional car (even then i paid it off in a year).

it wasn't until i wanted to get a personal loan that it hit me in the ass. sure i had good credit but i had almost zero revolving credit. Sure i paid my home, electric, etc on time. but not having any CC's really hurt.

now i have 2 credit cards. I pay them off on the 3rd of each month and use them up to 50-76% of the limit.

when i got my van I got such a low interest rate and payment I am in no hurry to pay it off.

With a nearly $3000 net paycheck (should I assume bi-weekly?), and you're living paycheck to paycheck? You've got bigger problems to worry about in the long term than a wage garnishment order. Consider this a wake up call. Get financial help.
No...I meant (originally) that I do not have $3000 to pay them off in one lump sum, or to come to a settlement. My take home WAS $2700 MONTHLY. This past pay period it was only $1700 something with $738 taken out.

That puts things in a whole different context now that things are clearly worded. That does suck a whole hell of a lot more. But at least you can look at it this way, you'll be done with them in ... 3 months?

I assume you've learned a good bit more about credit lending and debt management throughout this process at least.

I don't see how you are getting garnished before the court date. I thought garnishment was a result of judgement against you. If collection companies could garnish wages with zero legal involvement that would be insane.

Not accusing you of lying just shocked that that could even happen.
Not half as shocked as I was...

Edit: Just called the court, and it happened because I did not file a response within the 30 day time limit, so it was a default judgement.

It is legitimate, and should be treated as the gold standard and pounded into peoples' heads from the day they're born, at least when it comes to unnecessary/luxury items. Look at where our economy is going (hint: the shitter, long term) for an example.

Debt/Credit is a tool that needs to be understood well before being utilized. We're looking at about three generations now that have been taught to treat debt as disposable income. At which point do we realize that it's not?

The problem with that is he never responded to the court documents, and if $3000 is the last balance from Dell, the judgement will be for more than just the balance. They will add on interest and court fees.

I've got over 3K on CCs, paid the minimum for 5 years. I've already paid over the actual amount of the CC in just interest now.

If you are going to keep docs on me, you should keep up.

My mortgage company created a situation, not me. Also since that time I have doubled my salary.

I am well within my means currently, but that mortgage situation is still going on and my creditors are simply reacting to that reporting.

My M3 I recently sold I was on the fence about. I could have kept it, but I already had another new car (one year old). My M3 had $10k in equity and was really not the best car to be driving 2000 miles a month in.

Lol, I never entered a situation outside my means, I was put into one through misreporting.

My solution was to take down three certifications and get a better job.

I used my insurance claim to pay off the $40k in debt as well.

you gotta be careful about a situation like this. when they sell the debt, a collection agency can sue you and then tack on legal fees and turn a $3000 bill into say a $10000 one. i read one story about a guy whose $300 (or so) debt was sold by the irs and they turned it into say a $15000 debt and he ended up losing his house

also dont collection agencies try to settle with debtors? you might call them and they might say "ok you owe us $3000, well settle it with you for $1500 now". youd probably take a hit on your credit record though, so i dont recommend this

did he say this was a few years ago? if so i guess the stuff isnt worth much so it probably wouldnt make much sense to sell it

You'd actually be amazed... depending on what you're willing to do. Unfortunately it seems too many "Americans" have too much "Pride" to "stoop to such things" these days.

Either that or it'd be too much of an inconvenience for them. More of an inconvenience than the debt issues they're going through (no offense to the OP, since I absolutely have no idea what the OP may or may not actually be considering at the moment in terms of options).
