Do you know any state laws on this? There is no universal law of what a deadly weapon is. You're clearly not a lawyer because you would understand how asinine your statement was.

Ok, good to know you are conceding this issue since the DA has clearly indisputably taken the position the taser is not a deadly weapon in this specific context.

A DA misspeaking or verbally misstating a law on the spot is not very relevant, especially compared to after reviewing the law and consulting with staff and legal texts before making a charging decision. (If a DA misspeaking once somehow actually changed the law we would all be in a heck of allot of trouble.)

Ok, good to know you are conceding this issue since the DA has clearly indisputably taken the position the taser is not a deadly weapon in this specific context.

Nope that is clearly not how the law works. Again if this is actually how things worked, there would be essentially no point in police ever using a taser instead of a gun, or at least police would be constantly facing attempting murder charges or at minimum assault related charges for the use of tasers. (For that matter any civilian ever using a taser for self defense would be treated to the same standard to its use as if they fired a gun, which would mean charges would be fired in a huge number of cases.)

You can continue to wrongly mistake what the laws are in the this case, but that certainly does not change what is actually the law and at this point simply serves to personally make you look bad.

The law enforcment orginization page setup for donations for the two cops even lists:

"Per Georgia Law, a taser is classified as a “less-lethal” FIREARM as they do occasionally cause death.
(OCGA 16-11-106)"

That code they reference was 2017 so is more up to date that something from 2010. Also, APD says less-lethal and their academy uses them on all students as are of their training. Give it up already, you are wrong just admit it or go away.

The same DA also said it was NOT a deadly weapon.

No PD in the country promotes tasers as deadly weapons. If they were they wouldn't need them.

You made the leap a firearm is a deadly weapon. Law does not state that. Not all firearms are deadly weapons. Paintball guns are firearms but not a deadly weapons.
a) For the purposes of this Code section, the term "firearm" shall include stun guns and tasers.

You can't even read your own quotes.

I do not have any mercy when it comes to DUI's.
My friend layed in rehab for 8 months even because of a DUI person decided to go head on with her.

Anyhow, i understand the shooting officer getting a charge, but the other officer is charged with aggravated assault?
Really? For tackling a suspect who resisted arrest, you are charging him aggravated assault?
FML... anyone else find at least this part idiotic?

He brings up an interesting point but not a valid one. In that case the cops misused the taser and abusively attached the man. And he died.

A deadly weapon is any object capable of inflicting serious harm to another person. ... But even more common place objects such as a baseball bat, lamp, or even a pencil can qualify as a deadly weapon. Basically, any object used in a deadly manner can give rise to an assault with a deadly weapon charge.

In this case it aprears that the officer's life was not in jeopardy when he drew his weapon and shot the man dead.

Have you watched the video from the DA spelling each of the charges out? If so what are your thoughts?

The shooter fine charge him, the other officer WTF man.

What did he do wrong besides attempt to put handcuff's on the man and get his taser taken while he tried to tase.
So he is charged with aggravated assault with a deadly weapon.... I thought tasers were not a dead weapon.. wait i thought it police were allowed to tackle or attempt to tase a suspect which is resisting arrest.
Do they honestly think the other office misbehaved?
Seriously... what the hell is up with the entire City.

My thoughts, Atlanta is a messed up city period.
The original police chief resigning is probably the smartest thing anyone could of done.
She is probably chilling at her house going thank god im not knee deep in this mess giving me acid reflux and stomach ulcers.
No wonder all the cops are leaving, and are most likely going to be sick on blue flu day.

They dug themselves there own graves, there is no adjacent police force that will back them up because they will get charged for even looking at a suspect wrong.
The city wants to defund and demoralize the police... well GG, you wont need to defund jack, most likely the police will be dissolved from no one being there.

I'd like to see the digitally footage and see all the fact but from what I have seen so far the other cop should not be charged. We shall see once more evidence is presented. That charge relates to not providing immediate medical attention so probably going to have to hear what all the eye witnesses and the cops on testimony to determine get the full picture on that.

This is because an authoritarian mind set is established by the inculcation of the fear of deviance from social norms that can be anything from Taliban to Tibetan moral standards varying greatly in their depth of human understanding. Thus any society wide suggesting there will be a loss of threat to deviation creates the internal fear that all of the hatred they were required to bottle up in the process of having that fear inculcated means that the chains that keep that monster within them from escape. This is the origin of the fear of Pandora's Box, that if our repressed feelings get out we might remember the horror we went through as children.

This also of course means that where people in a society are deeply sick it isn't wise to suddenly release that repression because people are far to ignorant to understand in a short time the potential of mass psychosis coming out all at once. We need the police because we are sick and we have the police because we are sick.

To reduce the repression in a repressed society requires the wisdom of self understanding, knowing what we really feel. Such people don't exist unless because their creation is all up to you.

Yea, if there is reason to charge the second officer, it may be related to things he did or didn't do after the shooting.

The same sort of applies in the George Floyd situation. A couple of the other cops being charged were very new on the job, one had only a couple of days on duty, I think. Easy to say they should have intervened, but not easy to do when the person doing the action is a very senior supervisor. Perhaps it is justified to charge them, but I do feel sorry for them in a way.

It's more than that. A taser is listed in Georgia law as a deadly weapon. It may not be listed that way everywhere, but it is in Georgia. Doesn't matter how the implementation makes it deadly only that by law it is counted as such. It is not considered an improvised deadly weapon either by Georgia law. There is also the fact that Brooks already tazed the first officer and he wasn't at full capacity anymore because of it. If he got a good taze off on the second officer, he could have easily taken their firearms and done far worse. He had already demonstrated he was willing to commit violent acts, and the police knew his record before going in since they ran his plates. Meaning they knew he had done violent acts before. Still the initially treated him well which is why they didn't do anything forceful at first. Which is why Brooks was able to surprise them when they were putting on the cuffs because they thought he was cooperating fully with them. He then punched them, stole a tazer, tazed one officer, and was running while trying to shoot the tazer behind him at the other officer. Which by video looks like it hit but didn't go off on the second officer. Georgia law also allows police to use deadly force if the perpetrator has already used felony force and if fleeing the police reasonably believe the person to use it again immediately. The DA has no case here at all. Not by how the laws in Georgia are currently. He was talking out his ass for politics and was doing so before any of the investigation was done. I don't any charges sticking on these cops despite anything the DA says based on current law in Georgia. The cops have two legal reasons to use deadly force and Rayshard met both of those reasons. He use felony force on a police officer, and with his past it could be reasonably assumed he would use it again in his escape, and he also stole a deadly weapon under Georgia law and has used it not once, but twice on officers.

While he was shot in the back it was as he was retracting his arm from shooting the tazer backwards. There is a lag delay in that situation and no jury or judge in this country would find guilt on those officers for this situation.
