This jumped out to me:

4.1 User Content. The Services may enable you to submit, post, upload, or otherwise make available (collectively, “post”) content such as video clips, photographs, reviews, public messages, ideas, comments and other content (collectively, “User Content”) that may or may not be viewable by other users.

4.2 Our License to User Content. When you post User Content on or through the Services, you grant Purch a world-wide, perpetual, irrevocable, royalty-free, non-exclusive, and sub-licenseable license to use, copy, distribute, reproduce, modify, edit, adapt, publicly perform, publicly display, translate, create derivative works from, sell, lease, transmit, disassemble, and publish such User Content, in whole or in part, in any format or medium now known or developed in the future, including without limitation for promoting and redistributing part or all of the Services (and derivative works thereof) in any media formats and through any media channels. You acknowledge and agree that your user name may be associated with any User Content that you post.

It looks to me like anyone posting anything here (in the photography forum's photo of the day thread, for example) could have their photo sold in any manner of ways without their knowledge or consent.

They've figured out new and even sleazier ways to monetize your clicks and your submissions. Those needed to be covered in the new terms of service.

Bottom feeders. Purch does with online content what a slumlord does with properties. Buy them for cheap, milk them for what they're worth, invest the absolute minimal amount of time and money possible to keep them going. Until they fall down or burn to the ground.

I noticed that too, i sure aint posting any pics now thats for sure.

I didn't bother reading the TOS - just the part snipped out here.

If I currently have photos posted in the Photography sub-forum, those would follow under these new TOS's? Or, just new photos/posts going forward?

If I nuke links to all photos I have posted in that sub-forum, would that revoke immediately their ability to use them, or could they use "internet history" to still use those photos?

Posted this in the pic thread but I thought I'd ask here too. I am unable to decipher the legalese re: whether or not it matters whether you host content via the img function on the forum or just post the link to a picture hosted elsewhere. Any ideas?

Realistically, guys: WTF are they going to do with your photos? It takes these idiots weeks to fix a simple bug. You think they have their minions combing the forums for great photography? And what if they found some?

Page views, banner ads, click-throughs. Sell the site if they can somehow grow revenue with zero investment in infrastructure. Rinse. Repeat.

They're slumlords.

Yeah, this place has definitely slowed down quite a bit since the transition. The only sub with any significant activity is p&n and that place is infuriating.

Has anyone here started migrating to a different forum?

Purch claims to be rapidly growing, constantly evolving digital content and services company. I wouldn't be surprised if they have a past, current, or present affiliation with a photo stock company of some sort, especially since they want to "shape the future of digital publishing."

Put photos online and they will get copied and re-used w/o permission, credit, or compensation. Thus it has been and thus it shall always be. <shrug>

I'm just here to chit-chat anonymously, not flesh out some company's profile of me that shouldn't exist in the first place. Goes to show you should never reuse the same password, email, or user-name across websites. New site = new identity.

We need strict laws giving people control over how their info is used these days. Everyone should have their own personal TOS or the ability to overrule a site's TOS. I ought to submit my own TOS to Purch and not return unless they agree to my terms.

Anyone have any impressions on how the TOS would act if we just provided a link to the images instead of embedding them? It would be my assumption that the TOS wouldn't apply as Purch isn't hosting the images. Could be a way around it

Yep Eulas and stuff are purposely made ridiculously long so that the average person is not really going to get anything out of it.

Same with big agreements like the TPP. When that was initially put on the table people had to sign it before any person would even have time to fully comprehend it. Even now most people don't fully comprehend it except for the ones who wrote it and once lobbying for it.

I skimmed it quickly, a lot of it seems quite chilling. Too bad governments don't care about people enough to want to regulate this kind of thing. A corporation can stick anything they want in their EULA and get away with it.

Here's the funny part, with how strict IP laws are these days, a corporation would sue a person to oblivion if they used their stuff... but a corporation like purch can do what they want with stuff an individual publishes. It seems IP laws now days are only to protect corporations.

That would be my assumption as well. However, I yanked my avatar. It may be made of public-domain images, but I believe the way I combined them is copyrightable, and I don't grant the right to sell it or make derivative works of it - or even to use it in many cases.

Wow. Wtf? I've been thinking about not coming here anymore, but I didn't really have a good reason. With that said, I'm not worried about this particular case more than what would probably be deemed reasonable, but it makes me leery of what else is in there and how they'll try to hold me accountable for who knows what. I think I'm going to delete my account assuming I'm even allowed to do that at this point. I already feel a small sense of loss, but I think the AT I know and love is long gone anyway, so the nostalgia is just that.
