No one is going to sue them you "stupid" "ass".

The only question is:

was it really unintentionally posted on their site OR
was this deal intentionally put up on their site to gain cheap publicity (okay, negative but publicity nonetheless OR
was the item in their inventory "hacked" (cough) like the mod offered as a possibility (from their email to him)

Keep in mind that there have been precedents, buy.com comes to mind, where class-action lawsuits have challenged disclaimers and prevailed.

that kind of disclaimer is only fair for a company to stay in business... i mean c'mon, how can they expect to survive with a bunch of deal monkeys like us jumping in on every pricing error? =)

Yes I am sure that they intended to drive Customers to their site because everybody who saw that also bought a full price system. PLEEEEEEEEEEEEEZEE! Comon pricing error are just that ERRORS!! If they try to ship at full price then you have an issue. If they cancel you have none.

Not true. Take a local store in your area, for example. They advertise a price on the window of their store and you notice it as you drive by. You end up pulling over and taking them up on it. They respond with...sorry, that's not the right price but (enter your excuse here...&quot;we will sell you this other one for that price&quot. If a store advertises a product for a price, they must sell it to you for that price...if they have it in stock. You can't just post a dislaimer like &quot;No matter what, it's your fault, not ours and all your base are belong to us&quot;. You must also follow state and federal laws.

Covering your ass is one thing...but with online stores, if there is a pricing error, they could lose millions...I don't always think it is right to exploit their mistakes like a 50cent whore. But hey...I ordered one anyway.

Well, actually Rkelly, it may vary by state, but generally retailers are not &quot;bound&quot; by their ads. The courts have interpreted advertisements as an invitation for consumers to make an offer, not an an offer in and of itself from the retailer. The retailer is in no way bound to accept your offer (even if it's the one in their store window).

There are, however, consumer protection laws that address the issue when the ad was intentionally placed to deceive consumers (e.g., bait and switch). If there was no intent, then you've got no case. Typically it takes a retailer doing this a number of times to gather sufficient evidence to prove intent. Of course, once your offer has been accepted, then you would have a binding contract, but that's another lecture.

rkelly: dude, it is very nice that some lawyer is very happy with a classaction on buy.com, but that does no good other than to drive these frail dotcoms to bankruptcy, therefore ending any chance of legit deals at those sites. thats my 2 cents.
