as such they are entitled to instate benefits.

Change the laws to state that the person must be a legal resident of the United States and have a permanent residence in California.

The California Legislature passed the controversial measure in 2001 that allowed any student regardless of immigration status who attended a California high school for at least three years and graduated to qualify for in-state tuition at the state's colleges universities. In-state tuition saves each state college student about $11,000 a year and each University of California student about $23,000 a year.

A state appellate court in 2008 ruled the law was unconstitutional after a group of out-of-state students who are U.S. citizens filed a lawsuit alleging the measure violated federal prohibitions barring illegal immigrants from receiving post-secondary benefits not available to U.S. citizens based on state residency.

But the state Supreme Court noted that the California law says nothing about state residency,

Ummm, don't you have to be a California resident to attend a California high school? If so, the SC's reasoning is extremely flawed as the barrier is exactly the same, whether or not "residency" is explicitly enumerated in the statute.

On further thought a student at a private CA high school might not be a CA resident. But then, how many illegal immigrant children attend private high schools out of state? There are no non-resident public school students that I can think of; even students in border areas don't cross state lines (People living on Kingsbury Grade just inside the Nevada border of South Lake Tahoe get shipped to Zephyr Cove a decent ways away instead of attending either of the high schools in the California portion of town).

A common sense solution that will never happen until there is rioting in the streets of CA. It's counter to everything held dear on the West coast.

It always amazes me that people that support this kind of thing think they are being compassionate and enlightened but they're just supporting the exploitation of a people and the creation of an underclass. If you keep waving carrots in front of them then of course they're going to keep coming in to be exploited.

We have government telling little kids they can't have flags on their bikes or sell cupcakes but they sure as hell can enter the country illegally and get social benefits.

With CA's UC system raising tuition fees, classes being crowded and hard to come by for legal immigrants and US citizens this ruling is going to further create a FUBAR'd system and basically contribute to bankrupting of this state. I guess the next move for "liberal progressives" will be to give illegals the "right" to receive welfare and be able to cast votes in elections.

I love the endless parade of people coming in here predicting all sorts of bizarre and frankly laughable consequences for this. Now I know you haven't done a single shred of research to back up your idea of 'bankrupt city', and it's extremely likely you've never attended a UC or a Cal State school, (unlike me, a UC San Diego alum) but by all means, break down exactly how much you think this law will cost California a year.

Use numbers, use sources, be specific.

If you knew the slightest thing about California you would know that these sorts of programs have next to zero do to with the budget problems the state has. The proposition system is the #1 culprit through the stupidity of conservatives in drafting prop 13 (primary) and the liberals in drafting Prop 98 (secondary, as it was a response to prop 13).

What's it cost now? I went cheaper cal state but even Berkeley was only 3K a year back when tax paying children attended.

All you have to do is look around San Diego to see how bankrupt it is. I went there a few weeks ago to see a freind was and shocked how streets and sidewalks looked busted up potholes. Huge transformation from my last time there in 1980s..what glorious beautiful city it was... time away really gives perspective. In 20 yrs you may have to go to Tijuana for nice ambiance at this rate.

Prop 13 was in effect in the late 1980s as well... actually started in 74 76 I forget. Nice try tho.

The reason this even made into to the California Supreme court is that students who were US CITIZENS who were not California residents were paying the higher Out of State tuition rates while illegal aliens were able to pay the considerably cheaper In state tuition rate.

Why should illegals who are not legal residents of the state be able to get cheaper tuition than that of legal citizens of this country???

Craziness. Like why should bankers who literally robbed & conned us get tax payer money and record bonuses? How can a Cargill CEO become head of USDA? How can some cities pay out 75&#37; in pensions to cops and can't hire new cops? World is upside down.

Yes, it is. Out-of-state citizens don't get that, and they at least pay federal taxes. The whole point of getting in-state tuition is that you're getting something back for your state taxes. Illegals don't pay state tax. Therefore, they are stealing subsidized education.

No illegal alien should EVER get a privilege that a citizen doesn't get.
