Can I get sued for this.

Well, long story short this fat, old bitch was driving in front of me and stopped in the middle of the road cause she saw a parking. There's still a lot of snow around here so there was no way for me to get by and for her come back into the parking (People were right behind me). She moved up a little and decided to drive back, when I saw her car move up, I started moving up too, and I didn't notice but she was moving back again as soon as i hit the accelerator >.< I was able to slap the breaks down hard but I couldn't come to a full stop (in fact if I think back she might have hit me lol) . Anyways I hit her car, but it was very light - the cars had absolutely no damage and she was complaining about back pain but the paramedics came and looked at her and told her to go home cause they didn't see any need for her to go to the hospital(I mean literally it was a light hit).

The cops also came in and saw that the car had no damage and one of the officers started cursing the old lady out in Spanish cause everyone knew that this shit was bullshit. I got the report from the police and they said there was no damage to the cars and the old lady went home.

My question is that can the bitch come after me to sue me cause of this? I am kind of scared about it and don't really know what I should do. On the bright side, my girlfriend is a an auxiliary cop and the her supervisor told her to bring the report to him so clear the record in my favor (whatever the fuck that means). But yea, would like some more input on this.

Don't you have car insurance???

Oh and next time, look before you start moving your car, ESPECIALLY when it's slick with snow. Just make sure to keep that in mind and this wouldn't have happened.

I don't know about a suit, but you need to improve your driving. If you were following closely enough and moving quickly enough that you couldn't stop in time, no matter what the person in front was doing, you screwed up. Consider this a warning- a lot of people don't get off so easily when they run into somebody, especially somebody who's willing to lie for money.

Of course I have insurance but I still don't wanna get sued, the insurance company is going to raise their rates on me then :-/ .

Whether you get sued or not, the insurance company may raise your rates just for having a claim...

Not only will she sue you but she will also get paid. It will be cheaper for them to just give her $10k than go to court and win. Bet she has done it before.

lol, how does cursing indicate I am an aggressive driver? I would say that proves I have emotions. I never once yelled or cursed at the woman while we were at the scene, I was the only one who wanted the situation to diffuse. The motorists behind me came and looked at the cars and yelled at the woman too for blowing the situation up for no reason.

The first thing that the cop said on the scene was "this is the accident?"

Basically I tried very hard to diffuse the situation but she thought she was getting some easy money. If she tries to sue and I have a choice I will fight it, no easy money for her.

Did you get cited?

If there is no official report saying that you hit her, she would have a very shaky argument. You can always say she backed into you.

You are at fault, yes you can be sued for anything.

I would also ask did you receive a citation? What did the police report say?

Generally running into the back of someone is one of the few instances where you are guilty no matter what happened. I guess they figure you're going too fast. My gf ran into a young Mexican kid several years ago who was completely stopped in his lane and she didn't have enough reaction time after realizing he was stopped (no brake lights). Everything was fine until the kid's parents got there. He didn't give a shit and seemed fine. All of a sudden he had *whiplash*. An EMS woman commented that "this is bullshit etc". To make a long story short, his parents sued my gf's ins. co. THREE TIMES so far! I forget the amounts but they got a shitpot full of money.

I guess it's possible as others have said of a personal lawsuit, but most likely the ins. co's will duke it out, and your rates will go up.

Can she sue you? Absofuckinglutely yes. You can sue anyone for any reason at any time. I'm pretty sure I heard Dr. Drew was recently sued for putting alien implants in someones mind remotely. Now had he not defended against that - a person could have collected and put a lien on any real property.

Will she? Probably yes.

If you lived in the USA where I do (America's Wang) - she would easily collect $10k. Its easier to pay it out than to defend. She doesn't even need to have insurance herself. She doesn't even need to be a citizen, speak English OR be here in the USA legally. She can have been breaking the law or driving completely inappropriately too.

This happened to my wife exactly. It was raining, lady was at a red light, turned green, lady hit the gas, so did my wife, lady slammed on brakes - went away in ambulance uninjured and collected $10k from my insurance company and my rates went up $38 per month.

If you lived in the USA where I do (America's Wang) - she would easily collect $10k. Its easier to pay it out than to defend.


There's even a name for that: It's called "Nuisance Value".

To clarify to my original post, she was trying to get into a parking spot along the sidewalk. She came back, then moved forward, then came back again. The collision happened the second time she moved back and by that time I had already started to accelerate. As soon as I saw her move back though I slammed the breaks but it was too close to her car.

I don't have the report with me but I know for a fact that there was no damage cited to either cars by the police officer and that the woman did not go to the hospital, she just got checked by the paramedics.

My girlfriend took the accident report to her supervisor( shes is an auxillary) to see what he can do, as far as I can tell he can clear my name but I am still scared cause the car and insurance is under my dad's name and I don't want his rates going up for something stupid I did .
