Can you own the beach?

I just moved and I now live(sp?) on a creek. Jim creek in arlington washington USA. And me and my friends got tired of our usual swimming hole so we walked up the creek a mile and found a much superior spot. Its got a huge beach BIG deep swimming hole and a rope swing that goes into the water. In view you can see a house up on a hill and there are some trails to it. There is also some firewood on the beach (that we dont mess with). We had a great day there yesterday but when we went back today there were signs that said "no trespassing violaters will be prosicuted(sp?)". We ignored the signs and nothing happened. No police the people didnt get out of there house and say something, nothing. I really doubt that they would call the police because they built a damn on it to make the swimming hole better (and it is a salmon run). My question is can they tell us to scat? I mean its not like were doing anything to the property. We arent littering making fires being loud throwing parties, bringing 20 friends. We are just going off of a dang rope swing. And if they were to go down there we would leave. We arent the suing(sp?) type of people (if we are dumb then we deal with it). Should I leave them a note saying this?

If they own the land, you're breaking the law. And yes, they can own that land, even the land on both sides of the creek.

Sounds like you are on someones land I would sic the hounds on you and your hoodlum friends.

They can own the land on both sides (i.e. the beach itself) and the portion of the creek that goes through their property. However, different states/counties/towns have different laws concerning this. I know that at my parents' house, they own the land on both sides of the creek, and the section of the creek that runs through the property. I have heard of some states/counties/towns that have it so that the creek is owned by the town or local government, as well as a certain number of feet of land past the creek's high-water mark. You would have to check with your local town/county/state to find out what the "policy" is.

Yes, you can own beaches. I've been to a private one before. We had to pay to get through, though.

You should avoid trespasssing. You don't want to have to check that little box when applying for a job and you're asked about your criminal record.

HA! Im a minor. According to my understanding, it gets wiped off of my record when I turn 18. (or maybe not).

The creek behind my parents' house is also a salmon run. It is against the law in the county to build a dam of any kind on the creek, even though they own a section.

Not in California, beaches are public property. You can own up to the edge of the beach, but from the beach down to the water is public property.

They define the edge of the beach as the mean high tide line, I believe.

If the stream is navigable, then anyone can be on the beach. But, if it is not listed as such, than yes, they own the beach.

In general you can own a body of water only by owning all land it touches, thereby preventing access. Of course, governments hold almost complete control over what you can do to a body of water under environmental and other regulations. The impact of this is of most interest on bodies of water that have tides and waves. The limit of land is considered to be the line that is not wetted by the water. As a result, you can theoretically walk continuously along oceans and large lakes without tresspassing once you get to the water. It also means that rising and falling lake water levels change the size of properties.

I don't know where you are from, but that is incorrect in most places. If the steam is navibable then they can be in/on the stream.....but not the beach if it is privately owned property. A perfect example is my lake house. It is in a cove that is stream fed and if you step off your boat onto my property or my boat house then you are tresspassing.....PERIOD!

In Louisiana the waterways are considered state property. If you have waterfront property and then a heavy storm comes by you back yard becomes state property if it floods.
