Car accident...who's at fault?

How long between the first swerve and the accident did the OP have? You wouldn't claim he could have avoided the accident unless you knew this, right?

I actually did take a defensive driving class a few years ago. There was about a second or two between the first swerve and the accident.

Seriously, like I said before... depends on the state this occurred in and the adjuster's arguing on each side. And the amount of damages. And if there are any injuries. And how busy the adjuster's are on any particular day. And which insurance company you/they have.

The police report has her stating that she attempted to make a left turn from the center lane.

Wouldn't matter. As long as the police reports states that she made an illegal left hand turn from the center lane, insurance will make her pay. There are times where I do not issue a ticket (very rarely though) and insurance still makes the left turner in this instance pay out the nose.
