Car insurance question

Posting from my phone so I'll be brief.
Have progressive insurance
Got into a fender bender 2 weeks ago (stupid wise and beautiful woman ran into the side of my car in a parking lot while I was parking)
Got pics and a witness but progressive is saying since she's trying to blame me, we're both responsible for the dmg
I'll be using my own policy to fix the door dents if my arguing doesn't get me anywhere tonight
First fender bender Ive been in in over 19 years
Will my premiums go up? The estimate at the body shop was about $800 to fix it

Yes, your premium will go up eventually if you make a claim. Since the other lady isn't accepting fault, there's nothing else you can really do other than pay for it out of pocket or get your insurance involved.

If you make a claim with your insurance, they will pay for it (minus deductibles), then attempt to sue or otherwise settle with the other insurance company.

Thats what I was afraid of. In this case, we both have progressive. The agent that got assigned my case is a POS. She doesn't return my calls until I called the 800 # to complain. I have a feeling she didnt bother to call my witness I know the other agent didnt talk to my witness.

I have been hit a couple of times and both were not my fault. My rates did not go up. I have Mercury Insurance in CA.

I have home owners with State Farm and my house got robbed. State Farm bastards doubled my deductible.

If she hit you, how can it be your fault? Did you run a stop sign or otherwise drive in front of her when she may have had the RoW?
Just tell your agent to do what you pay them to do...stand up for you and make HER responsible for the damages.

I dunno what she told her agent and Thats part of the problem Ive had with Progressive. They never return freaking phone calls and its aggravating! It took 4 phone calls in the span of a week with a 5th call placed to the 800 # before I got my agent to return my call. Ive already left two voice mails with the other drivers agent. I'll definitely be on their asses to the bitter end. I'm just worried about my rates going up if I end up going through my policy :/

Pay for this one out of pocket and find a new insurance company, if Progressive is this shitty to deal with for a minor accident imagine if something worse happened.

Most insurance companies are a pain in the ass to deal with when both parties have the same insurance.

That said, who is your witness? Friend, family, someone that knows you, or are they an independent 3rd party?

If her policy doesn't pick up the tab $800 isn't worth the claim.

Several relatives of mine work for various insurance companies...

bottom line is sometimes one insurance company's higher premiums are for other reasons than a padded CEO's bank account.

Parking lot usually = security cam. Any remotely intelligent person who truly believed he was not at fault in an accident would have obtained a copy of the video. If you didn't you're in a he said, she said situation and without REAL evidence you're both equally at fault. So pay up now or pay up later with higher premiums.

I have to say, we've had three accidents over the past 8 years and our insurance never went up. One was my wife's fault. Another was some idiot rear ended me on interstate for following too close, and another was some idiot hit and run (sideswipe) me on interstate! Thankfully I got his plates and he got a shitload of tickets and my insurance sued him and I paid nothing out of pocket. Our insurance company's has been absolutely wonderful and they were there at every turn to help us. Rental cars, next day service for people to come view the vehicles, letting us choose the body shop or dealership. I could not be happier.

I read shit like this and I'm so glad I never got a cut rate insurance or have to deal with this bs. The great thing is I've actually checked the prices of other vendors and ours has always been less.

Did you get a police report?

Parking lots are generally private property. Police usually do not have jurisdiction on private property if there is no injury or crime. They can write a report, but it's he said vs she said. It all depends on state law though.

I called the police but since its private property, they said they'd only come out if their were injuries or if one party refused to give identification.

This is to highlight that their insurance probably won't end up paying out. Depending on your deductible and your state, it may not be worth it to file a claim. In california your rates can't go up for filing a claim, but there's typically a discount associated with not filing claims over years, and you'll lose that if you do file.

Personally, I'd take it to a paintless dent removal place to work their magic for a lot less than $800 or whatever your deductible is.

Just an update. My insurance found me not at fault and her agent found her not at fault. My agent asked me if I wanted to use my policy. I then chewer her out a little about needing to do her job and go after the other agent.
After 3 days, the other driver's agent called me and said they're accepting liability and asked me where I want to take my car /yay

On a side note, my rental came with two keys. But they're chained together. We'd would they do that. If I lose my keys, I'd lose both.

This is not always true. I had a few claims with State Farm and my car insurance never went up. I also had a homeowner's claim, and my rate never went up.

right, in your case.

Car premium will mostly go up if insurance pays any money out.

And homeowners insurance works differently. They don't care for your claims. They care for claims in your area. My homeowners went up each year, because we had storms every year and many people needed sidings and roofs replaced.

The two major reasons for insurance premiums increasing are:
1. Change of location
2. Claim that your insurance pays out on.

If you make a claim, but your insurance company was able to recover those funds (i.e. sue the other insurance company) then you're probably fine. But if you're at fault or they CAN'T recover those funds for some reason, it's just a matter of time before they go up.

Another thing to consider is that a lot of insurance policies are overpriced. If yours doesn't go up, it may already be expensive. Also, the models of which your premium is based on are not published, so we can only speculate.

If you have a good witness and great pictures to support then file a lawsuit against the person that hit you in small claims if you did not get the claim you want.
Get an estimate and take that with you. Sue for the full amount and court cost.

I had to do that and had plenty of pictures and road signs. He lost very easy in court yet his slimy insurance company tried to say they could not prove fault BS.

I had the opposite experience with Progressive. Someone hit me in the rear, but I was stopped in a cab/delivery only spot so we both got sighted and asssigned 50/50 fault. I just resigned to paying for my repair out of pocket, but Progressive called about a week later and took full responsibility. I just feel that they are inconsistent with assigning fault.
