By ANY measure of logic, whatever goes about Clintons email server goes about Trumps unsecure android phones.

When Comey spoke isn't now. The FBI has since then, fairly recently "No, it didn't happen". Comey made an rational statement because he couldn't absolutely rule out the unlikely. Since then? Now he knows. Why don't the Comey haters ask him now about that? Yeah, that's going to happen.

Because Hillary, of course, even there's no actual proof her email system was ever hacked, merely breathless innuendo & accusation from Gohmert, the Daily Caller & their alleged "sources".

I already figured that must be the case, but what I'm saying that even assuming the worst, that her emails were hacked, how does that make her criminal? I wish I knew.

Their argument is that because the Espionage Act allows for prosecution for "gross negligence" in the handling of classified information, the theory is if she got hacked the harm caused makes it worse.

And Comey originally stated that she was guilty of 'gross negligence' in the initial drafts of his public statement. Strzok knew the implications of this and had Comey water down his language.

He wasn't citing the Espionage Act itself, but a reasoning some hold as valid

1 You gave the first as a given in this scenario.

Whoever, being an officer, employee, contractor, or consultant of the United States, and, by virtue of his office, employment, position, or contract, becomes possessed of documents or materials containing classified information of the United States, knowingly removes such documents or materials without authority and with the intent to retain such documents or materials at an unauthorized location shall be fined under this title or imprisoned for not more than five years, or both

Hillary had them on a private server outside the control of government security. "If hacked" doesn't apply. "Gross negligence" whether true or not isn't mentioned. There is no mention "if harm results".

Improper handling itself is in violation of law, period. The ONLY saving thing is if there were no classified information being kept.

So far as I can tell from reading through the list I'm linking below, not one person has ever been convicted for "gross negligence" under the Espionage Act. I'm not sure if anyone has ever even been prosecuted under that theory.
