For those who suddenly got their panties in a bunch over their just discovered 2-tiered justice system, I suggest this is where concerns should be placed.
Evidence of a two tier justice system is that Trump would be in jail right now if he were you or me.

Doesn’t change the fact that he’s fucked.

Nah. First, leaking the audio of a conversation contained in the indictment is meaningless and even if she did she will lose on appeal. People need to stop inventing ways in their head for Trump to get out of this.

Trump’s only way out is a Republican winning in 2024 and pardoning him. Legally he is completely fucked.
I'm not saying you're wrong or it won't go down the way you suggest--I believe that is the case--I just can't understand the value of leaks like this (from the perspective of prosecution). Can you speculate it as to who it would help the most, and thus where the leaks likely come from?

It's pretty obvious how that went down with Hodges, and we know that freely-available trial evidence has a history of being dismissed at/prior to trial for various jury-related reasons.

I'm speculating here. We know the judge is a sycophant for Trump, so I think it's silly to suggest that no such shenanigans will be deployed here, despite the recent history of them always being deployed.

But when a mistrial happens, does it go back to the same judge? Or can change of venue be requested?

my guess is that the trial gets delayed and moved again and again, due to the drip drip of leaks. The only real strategy for the defense going forward. Of course, if it gets moved, it would have to be New Jersey, no? That sounds problematic for Trump.

But like fsky says, Trump's only option is to get elected or win a pardon from a GQP winner in '24. I think this is the purpose of delaying as much as possible, and no, I don't think that is a hot take or anything.

My very simple question is: who benefits from leaking prior to trial? I don't think Trump is going to "Get away" with this at trial, assuming the trial happens. That's not my purpose here, which I thought was clear.

I think it came from Trump or someone in his camp as a way to get in front of it and decrease its damaging effects at trial.

As far as Cannon I agree she will try to put her thumb on the scale in Trump’s favor but when doing so she will need to do so in ways that are not so egregious they get her thrown off the trial and then overturned on appeal. Saying ‘you can never have a fair trial so case dismissed’ is something that won’t stand.

I agree that Trump will try every trick in the book to delay the trial until after the 2024 election.
