And thats pretty much the entire argument any time we have a tipping debate. An argument that never gets a good response.
The whole concept of tipping is just plain stupid. People should be paid the wage they earn and thats all. If they dont like the job they can do what I did: Join the Navy and work your ass off for less than minimum wage and pray you survive at least 4 years, get an honorable discharge and can dip in to that generous 14,100 dollars for college.

Most other countries in the world dont even have tipping, its a concept people dont understand. Its only used in a handful of western cultures, and its always a huge topic for anger, hatred, and arguing. It never seems to solve any problems and when people rely on it, it causes problems.

I agree...its not my fault what your career choice is. I shouldnt HAVE to pay you a gratuity. I do not mind tipping for good service but I do not feel like Im obligated to do so.

didn't partake? Did someone who works there take your order? then take it to the cook? then get it when it's ready? and ask you if you needed anything as you were picking it up to go? Aside from sitting at a booth and getting a glass of something to drink, and them stopping by twice for 10 seconds to ask if everything's okay. The take out order is exactly the same, you tip less because they don't have to spend the extra 30 seconds re-filling your drink. But nothing else is different. So I would say a to go order you're definitely partaking in their service and using a server to do it. Unless a robot answers your call, takes your order and gets it for you auto magically.

Tipping for crappy service sucks, but everywhere I eat has signs posted everywhere saying parties of 6 or more get a automatic gratuity added to their bill. I don't see how anyone could possibly fight this and win. It's posted, if you don't like it go somewhere that doesn't automatically add it. Chuck-E-Cheese is about the only place I can think of that doesn't though.

BTW - At least in California, a mandatory addition for parties of 6 or more is definitely legal. They consider it a legal binding agreement because it's posted for everyone to read, and by eating there in a group of 6 or more you're agreeing to the conditions posted. It might very in other states I dunno.

Sorry but simply "posting a sign" doesn't make something mandatory. I can't post a sign on my front lawn that says "All people who walk on lawn subject to $800 fine." and have it be legally enforceable.

Actually, if they wanted to nail this restaurant for crappy service, they did exactly the right thing. Sticking around and getting arrested was the perfect media opportunity to severely hurt this restaurant. Sure, they might get their $16, but they have lost big bucks for this retarded PR move. This could easily put the restaurant out of business.

I was managed a restaurant for about 2 years, and I saw many single mothers (and mothers with dead beat husbands) provide for their kids by being kick ass servers.

How's about we set up an ATOT meet there? We can walk in with 20 of us, ask for a table, sit down, order drinks, then when we see the 18% gratuity we can cancel our orders and leave.

Mandatory gratuity is a racket anyway. If it was two parties of 3 it would take the exact same amount of effort but wouldn't require it, so it doesn't make sense.

The reason for it is due to those that should not be eating out to begin with.

Especially in large groups you are bound to have those that simply feel they aren't obligated to tip. By the restaurant including the tip (I feel it should be 15% though as a default) they are making it easy for those to simply divide the check.

Now you have the real filth of the earth that eat out with friends and then insist on dividing everything by who had what. Usually the server is left sitting there $20 or more short on the entire bill and no one then knows who was the one that shafted the group.

What ends up happening is usually the people that already put the most in cover the shortage and the waiter breaks even.

Those that are against this practice are probably those same dirtbags.

I actually have no problem with tipping. I will tip for good service and not tip for bad service. However, your arguement doesn't make any sense. That is not an apples to apples comparison. But I guess you have no idea what you are talking about anyways.

As a former employee of the food services field I am usually quick to defend tipping in general but I never liked graituity tax especially when they try to sneak it in and get the old double tip. I usually tip badly for bad service (but do tip nevertheless) and exceptionally well for exceptional service.

i have done the same thing. Went to a Chinese restaurant with my sister (there was 6 of us) and the service and food was just bad.

on the recipet it had a 20% Gratuity added (IT was NOT on the menu). i told the waitress i was not paying that since the service sucked and the food was awefull. She got the manager who said that i had to pay it or she would call the cops. i laughed and told her to. i put down the amount for the food+tax and then $1 and walked out. i have never gone back to that place again.

They got what they deserved for failing at reading and comprehension. The allegation, probably true, that the service sucked is irrelevant, the gratuity notice is printed for all to see.

Fuck them.

So this disclamier is ok then to allow shitty service? Fuck that. I would of not paid either.

err. its in YOUR POST. did you read the article you linked? here. from the 2nd paragraph (first one is very very short)

No that is older and different.
I posted that as courts have said over and over for the most part that a tip is not required. That is the first one I found and posted it. There are others as well.
