Article 2 Section 1 Clause 1 "The executive Power shall be vested in a President of the United States of America. He shall hold his Office during the Term of four Years, and, together with the Vice President, chosen for the same Term"
I don't know how it can be clearer the President is an officer.

As an aside could this be used rule a woman is Constitutionally ineligible for office?? After all originalism.

Yeah Trump is off the primary ballot unless SCOTUS does something, not the other way around.
This is incorrect. The stay keeping Trump on the ballot is extended, per their ruling, once appealed to the Supreme Court. See page 133, final section of the Conclusion.

"But we stay our ruling until January 4,2024 (the day before the Secretary’s deadline to certify the content of the presidential primary ballot). If review is sought in the Supreme Court before the stay expires, it shall remain in place, and the Secretary will continue to be required to include President Trump’s name on the 2024 presidential primary ballot until the receipt of any order or mandate from the Supreme Court."

Only fucking Trump would get a ruling like this. Everyone else in the world requires the appeals court to take action to overturn a previous ruling, but this is "if the appeals court does nothing the current ruling is void."

I feel #1 is a dangerous ruling..

That can be applied to future presidents...

But on the positive side we can drop the current investigation into Joe Biden since nothing will come of it.
Yup any rulings that grants POTUS more powers just gives Biden carte blanch to do everything with his new found powers to break democracy to save it from another orange monkey term.

Legal Eagle runs though the case. He's just rehashing all the details, found nothing new from his take.

How long before a State Supreme Court does this without staying the ruling to allow the US Supreme Court to weigh in?

Lol brilliant crackerjack lawyering by Habba. She was on Faux last night and called for Kavanaugh by name to step up and do the right thing for his president. Okay fine justices will obviously ignore any conflicts of interest but just keep digging that hole.

Someone will take a shot at it. My guess is the Supreme Court ruling has already been written, just need to date it and print it out.

It is going to be fun to see how they Calvinball their way around the utterly clear meaning of the amendment.

The reality is that no matter how they do it it's a win for Trump. His supporters were already fired up, this end run has them foaming at the mouth.

Trump supporters were already foaming at the mouth. We shouldn't avoid taking steps to protect our constitutional form of government because we're worried that the rabid people are going to be more rabid.

Plus, Republicans would also still be free to nominate any other huge shithead to continue their horrendous policies.

By ‘end run’ you mean ‘enforcing the plain language of the constitution’ of course. And lol - no. His supporters are already fired up, motivating them more does nothing.

This is what conservatives never understood. Motivating Trump supporters is why you keep losing. They get more fired up but since Trump supporters are utterly repellant to the rest of the country it just motivates even more people to vote against him. It’s why Trump got the second most votes for president in history and got buried by 7 million votes in the overall count.

It’s brain worms from 2016 that won’t go away. I for one am looking forward to the ‘actually this is good for Trump’ takes after he is convicted.

I can’t believe those dirty dems are making an end run around the candidacy of a 20 year old by insisting he has to be 35!

Only in America would it be controversial to say ‘you can’t run the government if you attempted a coup last time you did.’

I wonder if Trump will say "you owe me" at some point to Kav or ACB

Curious as to what the Supreme Court Justices are doing right now. Frantically paging through the law books looking for an argument to get the result they want? Consulting their paymasters to find out what verdict they are required to reach?

That particular trope has has passed it's expiration date, along with "the most important election of our time". Tripe.
I think 'the most important election of our time' is actually correct this time. Basically, there's a good chance if Trump wins it's the last free and fair election we will ever have.

He tried a coup last time and almost succeeded. You know as well as I do that he'll try another coup if he gets back into power and he'll have learned from the last one.

Jesey Mike's coupons are a rare sight. But, if you ever get anything at Subway without a coupon you are a fool.
