did you see the picture? from a distance it could certainly be a pistol. people have been shot holding objects looking much less like a gun than that nozzle does.

The bottom line they didn't identify themselves, the police chief in LB said this. People on here are expecting a drunk dude to realize they were cops even if they didn't identify themselves as such. And are saying "he should have known!" but are excusing the cops, who were completely sober from identify themselves. Something they're trained to do in any situation. Cops do that do there's no confusion, they did not here so it's all on them. It's not like they forgot to do something they never really have to do, in every situation like this a police officer is suppose to identify himself as such.

all i'm saying is that you do stupid shit, you're going to have bad results. obviously the cops messed up, but you can't put the blame completely on them. once again, until you show me proof these guys go around gunning down innocent citizens, i have to believe it was an honest mistake made in a bad situation. we pay these guys to put their lives on the line for us, and you can't fault them for reacting in a way to protect themselves. put in the same situation i have to believe most people are going to react the same way. for every 1 guy holding a nozzle, there are probably 1000 holding a real gun. probably even more.

if the guy was drunk and walked out into traffic do you blame the driver? or the drunk who put himself in that situation in the first place?

- people call the police, say a man is waving a gun around
- police show up, asses situation, try to get closer
- guy points what looks to be a gun at cops
- cops shoot guy

You guys do realize that it is not always advantageous to announce yourself, nor is it required, right? Some of you just need to go back to watch CSI.

Is this tragic? Yes. Are both parties partially at fault? Yes. Did the police do anything criminal, or agaist SOP. No.

And that's that.

That shouldn't be grounds for cops to assume guilt and open fire. In fact its more reason for them to have said "Hey its the police put the weapon down" Lots of people can be shot watering their gardens in the summer with a few well timed 911 calls if this is all it takes.

Two different people calling the police to tell them a man has a gun should not be grounds for them to assume he has a gun? You serious?

YES! Do you know how fucking stupid people are? Well this is case in point if you didn't.

EDIT:

And if they were assuming he had a gun why the fuck wouldn't they tell him to drop the weapon? "Come out with your hands up your surrounded!" I know its a movie cliche but the shit works sometimes.

This guy wasn't watering his lawn. If the nozzle was on the end of a hose and spraying water on his garden I'd say string the cops up by the nuts. But he was sitting on his porch with a black hose nozzle shaped like a gun, and then pointing at people with both hands as you would a gun. No sympathy.

Lots of people who know shit about police tactics.

When you get a report of man with a gun it's a serious situation. They don't run in there announcing the police have arrived because that eliminates any tactical advantage they have.

You want them to stand behind the fence with their bullhorn and announce "hey gunman, we're behind the fence. Be nice and drop the gun LOL."

OH SHIT HE SHOT US THROUGH THE FENCE AND WE'RE DEAD. OOPS.

McDonnell said the officers took positions to observe Zerby, who appeared intoxicated, and believed he had a gun as described by the callers, but focused on setting up containment of the area rather than contacting him.

As officers awaited requested backup units, the man pointed the object at apartments and played with it, causing it to make sounds similar to those of a gun being handled, he said.

maybe they should've grabbed one of these

I can imagine the sounds now

"ENEMY SPOTTED GO GO GO. STORM THE FRONT. MAN DOWN, MAN DOWN!!!"

not to mention assess the situation from a distance to determine WTF is going on rather than storm up on the dude sitting on his porch.

FWIW If someone is creeping on my property in the cover of darkness unidentified they will probably get a gun pointed at them. Just sayin'

Thats fine and dandy. But it has nothing to do with the topic at hand. You point a gun at anyone that has a gun and is trained to use it, you can expect to get shot (unless you know the person and you are a moron about guns).

Actually the topic at hand's you don't even have to point at gun at the cops, a hose nozzle's enough to get you shot and killed. Which brings us to the 2nd lesson, while cops are trained how to use a gun, they apparently have no training in when to use one.

When someone points something that looks like a gun at you, you shoot them. End of training lesson. You don't wait to ask the question "Is that really a gun?" because that will get you killed.

You really want to get upset at someone, get upset at the hose nozzle manufactures that made a nozzle that looks like a gun.

If a citizen with a CCW had been walking by and reacted exactly as the cops did, mistaking nozzle for gun...fear for his life..the whole nine yards, he would be rotting in jail right now.

Yep, apparently we now need pink plastic caps on the end of all hose nozzles to protect us from half-blind, dumbass, trigger-happy cops.
