Like I said before, you know that if the wife was in the house getting raped and the cops decided not to enter, you'd be all over them in about two seconds. All we'd here from you is how poorly trained they are and how they cannot be counted on to do their jobs.

You have to take into context where this occurred. Lakeville is a small town and particular, 'Sotans are used to having their noses in everyone's business. Having grown up in Minnesota, I can definitely understand the officers doing what they did. It would be stupid/dangerous in the East or a large city but, rural Minnesota is a whole nuther critter.

If my doors are opened (not just garage door), lights are on, and nobody answers the door, I want police to check it out. Something would be very wrong in my house.

The burden of proof isn't on me...

Cops just use the old "reasonable suspicion" line and go any where they want. Most people around here will lay down and take this bullshit. Pull this crap on me or my family there is going to be a problem.

In the summertime, when it was 80 out during the day, and it's cooler at night - I can guarantee my doors are open. I leave the keys in one of my vans 90% of the time, and my kids are constantly forgetting to close the garage doors. Yep, that about describes my house perfectly in the summertime.

As far as blaming the police in the situation in the OP - I don't know how significant crime is in that area. I don't know what the sub-culture of that area is like. There are plenty of areas of the country where I guarantee my doors would be locked. Not in this area though.

This would fall under the 'community caretaking' headline...would be very well received in some areas of the country, and (as you're saying) despised in others.

There are no 'common law' crimes in my state- unless it is specifically statutorily prohibited, it is not illegal. The article the OP quoted would not fit the elements of criminal trespass, and as such, it would not be illegal.

I?m definitely agreeing with what the cops did in this situation. Thankfully, most posters already elaborated on my exact thoughts as to why. =)

But I suppose it depends on the area, as always. If someone left their door open at 3am in the city here, then the police should definitely investigate. It?s ridiculous that the home owner wants to charge the cops for doing their job. If the same situation arises in the future, this experience may decrease the chances of those two officers investigating a household, and maybe that time there is a robbery/assault in action.

as for spiders/insects we got them any way. its just a fact of living out here.


finding a house with a open garage is not rare (or keys in the car). heck once we drove off and left my wife's keys in her car trunk (we were delivering girl scout cookies). a guy downt he street walked by and seen them in it. he took them up the house and put them on the key hook (wich was inside the house).

We have also had a neighbor call ask if we had milk/butter/whatever. then find out we are out and we just tell them to go get it.


Also nto getting up to answere the door at 3 am is not odd either.




Around here having a garage door open/tv on/door open would not alarm any cops.

That's my point. Your door is still shut, this guy's wasn't. I usually leave my main door open and keep a screen door close too at night (my screen door locks, too) so I'm no stranger to that.

Door of the house open - its unlocked 99.9% of the time, and its normally just a screen door
TV on - i fall asleep with the TV on all the time
Keys to truck i ignition - i leave my keys in the car all the time as well
no answer to knocks - its fucking 3AM what do you ecpect

The one time I forgot to close/lock my door I found a homeless man walking up my stairs in the middle of the day. He looked at me in a sort of crazed panic stare and then after a few seconds said "hheeeeyyyy man, you know your door is unlocked? I thought my friend lived here but I don't think this is the place anymore"

Yea, listen, I'd rather have a fucking cop come and inform me instead of a homeless guy. How about that.

You have to love the anti-police types in this thread. :disgust: You'll find any excuse to hate on the police/authorities.

This guy was putting himself in a seriously dangerous position where he was completely open to robbery of his house or his car. He was leaving himself (and more importantly the kids downstairs) open to murder or kidnapping. Whether or not this is because he's a complete idiot or just forgot (I can't see how he forgot to remove his keys from the car, shut the garage, and lock the door though) it is completely justified for cops to check on him and see what is going on. If not for him, for the kids downstairs.

The cops did the right thing here, and that's what I would expect them to do if I were ever in this man's situation and that's what I would want them to do. Cops are supposed to not just investigate crime but prevent crime, and that is what they did here. If you can't see that, then you are just a cop-hater (of which there are far too many on these forums). You don't have to blindly trust the authorities, but they are on your side (besides a few bad apples).

Actually, I fully support what the cops did. And I would hope in a similar situation at my house they would investigate. But I do not believe the cops are out to protect me, or even on my side. They are out to arrest people for crimes. They are simply looking for a way to either write you a ticket or arrest someone.

I'm with the group of "The world would be pissed if something WAS happening and they just left a note on the door."

Also, it'd be a different story if they decided to just walk in and search the place for guns, drugs, etc... but their intention was entirely on making sure the house was secure.

Private property is private. If there was no reported emergency, the police were as guilty of "breaking and entering" as a burglar would be. This would fall under illegal search and seisure if they had found anything illegal while they were there.

If you think they were right for entering this house, I'm assuming you agree with the patriot act as well.
