Copyright issues for GoPro videos

Hi !
I need some help.

I'm a skier.I take videos on my GoPro , and hike my DSLR into the backwoods.
I make ski video's with all of it.With other peoples music.
----

So here's my question :

What's the deal in the U.S. with 'fair use' ? (I'm in Canada , but you-tube is U.S.) ?

I am the cameraman/skier/editor/producer . I want no Ad's . I am not trying to make money.

I've sent out many email's asking artists/bands for permission , I'm batting 5% on that one , but I'm betting you-tubes 'bots' will block that one too....(I am trying to get pre-permission from you-tube on that one)

As someone that just wants to share some good turns with good music , it's very frustrating to have to do this.

Fair use does not really exist anymore unless you're a huge company with huge budget to buy the rights. You are pretty much expected to make your own music. Pretty ridiculous but it is what it is. Best bet is to host it yourself then you can mostly do what you want at least up until the point you get a DMCA notice, but not even sure if those are valid here in Canada. Problem is they could threaten to extradite as well so probably best to comply. YT is a pain because it's automated, so even if you use copyleft music, it might still get flagged.

One way around the bots is to make the music slightly faster or slower. Like maybe 5%. Do this before you start editing and edit with the modified version.

I'm actually just starting to look at free-license music .... And I always give credit to music on my videos.

I do my major hosting through Vimeo , on a paid for account , so I don't have to worry about ad's being forced in , but I'd like to get some exposure on YT .

I'm not worried about DMCA or extradition, I'm actually trying to be legal.If fair use is out , I'll pay royalties for my 200 views.That's my biggest issue !! I asked 20 bands for permission on my tiny little video's and I've only had 1 response at all.....it's like , I want to play by the rules , but it's apparently nearly impossible for someone like me.

Here in Canada 'SOCAN' is the legal body for music , I'm going to shoot them an email (despite what I've heard about SOCAN )...

As much as John Carpenter is my hero , I simply cannot ski/film/direct/edit AND write my own music.

Yep.
That's valid .

The only people to ever even answer me , was 'disruptor management' for 'The Chainsmokers' , and they said yes to you tube (no ads) .

Thank you to the Chainsmokers , and , Kudos to them forsure !! , I'm buttoning up that video now.
There's my 5% success.

I thought of another potential issue.

I use a gopro , and a canon dslr.I always give credit for them too...

If I put those logo's on my video forecredits , is that advertising ?

It is free , I'm just trying to give credit where it's due.

Copyright is weird, sometimes product placement can actually work against you, not too sure exactly what the laws are, but in some situations you can't show or say brands. Notice in some TV shows like Mythbusters where they arn't allowed to even say the names of brands. I did not even realize but bubble wrap is a brand name. They had to use a different term to name it. Shows often blur out the logo on vehicles as well. That said, you're probably safe to put "shot with a [brand/model] camera". Chances are for just a hobby video you don't have to worry too much about brand/product placement nor do you have to give credit, but you can. I think there's some more defined laws for product placement, as it seems to be more reality shows that will block it out, fictional movies will tend to have product placement and it's perfectly fine. Or maybe they have to pay royalties, I don't know. I think in some cases the company even pays the producer... it's just allround odd how it works sometimes. I don't think YT will block that stuff so I would not worry about mentioning camera brands, I think you're perfectly ok to do it.

As for music if you stick with indie / unlicensed the good thing is those bands tend to be more than happy to let you use their music as it's actually good publicity. They're also more than likely to actually respond to you than big labels when you ask permission.

Yep , that nails it on the head.

It IS just a hobby video...I think I will remove the forecredit logo's , and just do text credits at the end.Seems safe.

Once I have redone the intro/end credits , I'll link the video I have permission for.
