While you are "testing" it, check the serial number and your photos and contacts.
If it is 100% yours, start writing down his license plate number.
Make it obvious that you are writing it down.

My brother had his car broken into and his GPS and iPod stolen a few months ago. He looked on craigslist the next day and saw an ad for the exact same GPS and iPod together, so he called up to see if he could meet the guy to "buy" them back. Unfortunately the guy sold the stuff before he could get it.
