Although suits have been filed, this actually doesn't require the courts. The President's national emergency powers are derived entirely from Congress. As it is Congress (not the President, as Slow said) that is empowered through the Constitution to act on national emergencies, the President derives his powers in this regard through Congressional legislation, specifically the National Emergencies Act of 1976.
And hey, funny thing, Congress is expected to vote shortly on this very thing, possibly even today.
