FDA recalled almost 80,000 pounds of Kirkland brand butter


The issue is the butter package does not have an allergen warning on it. Pretty serious stuff...

The allergen in question? Milk

Maybe we just leave that warning off the package, and let things sort themselves out. I see no way to lose.

A supermarket in Denmark got a fine of 40.000Dkk $6000+ for writing (æg) egg with small letters instead of capital letters on their homemade meat balls, because it is an allergen...

It's not serious until someone is dead or close to it, i.e with peanuts or indeed, the subject milk itself.

The reason notice is important is potentially threefold.
One, due process,
Two, setting up a defense of "reasonable person" not doing a reasonable thing, transferring negligence and liability to the victim.
Three, a contract might be formed by the purchase of the product.

Either fine them or make them undergo an expensive recall so they stay compliant with labeling rules. Letting people go "oopsies" and letting it slide for things that might seem obvious to big brained ATOTers creates precedent for other companies to also cut QC corners and make their own labeling mistakes that could be more problematic for end consumers.

The sad part is this butter is 100% ok and safe, but yet will probably have to get destroyed. Such a waste. IMO they should really make exceptions for cases like this, if it's something as simple as a label issue, then make the company pay to print out stickers that get slapped on it before sale.

Or if that's too logistically involved due to the time it takes to get the stickers made, and staff required to put them on, allow them to sell it in bulk to restaurants, bakeries etc and other similar establishments where the end user is never going to see the label anyway.

Either way I'm sure there's a way to make this right without wasting it.
