It was a real gun, not a trick gun. The Joker used it to kill the guard when he walked into Harvey's hospital room.

The Joker kept saying, "I'm a man of my word," and I don't think he ever did anything to prove otherwise.

With regards to this question, yes I believe the Joker would've let Harvey kill him. When Batman was bearing down on the Joker on his motorcycle, the Joker kept saying, "Come on, do it," or something like that, indicating he wanted to Batman to kill him by running him over with the motorcycle. So I do believe the Joker had some desire to be killed, at least at times.

Another thing to point out is that the Joker mentioned how he knew his victims/foes more than their friends ever can; especially when pushed to the brink (I forgot the exact quote, but Joker said that to that cop when inside the interrogation room while Batman and Gordon were racing to the locations of Dent and Rachel). Joker, although extremely psychotic, knew the underpinnings of the people he tormented rather well. To him, everything was a psychology experiment. He probably analyzed the psychosis of many people through his criminal career to come to the level of understanding he had in the movie.

He said, "Come on! Hit me! I WANT you to!" He wanted Batman to break his rule against killing people. At the last second, Batman decided that he couldn't do it.

I cracked up when Gordon pointed his gun at the Joker (who was about to cut up Batman's face with his knife) to arrest him, and the Joker said, "Oh come on, just a few more minutes." What a card.
