i am still speaking with them, i think its the 5th csr, this one sounds little positive.
he told me to fax the email & he can place me an order for 2405fpw & if i am charged more than $428 for the new order then they'll refund the money

i just called 800 746 2470 i didnt know they have extensions

you need to have a case number opened with them & the csr need to put some comments on the case # regarding the refund

then you fax it referencing the case #

I suspect this is only for brick and mortar retailers that place a price tag on the item or shelf. I doubt it would apply here.

Your right, it looks like it only pertains to B&M

Prices: Overcharges ? AB 1721 (Koretz, D-West Hollywood) ? Prohibits any person or store from charging an amount greater than the lowest price posted for a product, even if there is an expiration date posted for that product. This law clarifies that expired sale signs that are not removed must be honored by the merchant. It also clarifies the language of the law to cover scanner overcharges.

But a law made in California does not apply across state lines to a company in Texas. If you want to stick Dell with something you have to nail them with a Texas law, many of which only pertain to Texas residents only. Theyare specificaly worded that way. Which is why there has been an advocation to get some federal guidelines for internet commerce for years. Many states, such as Texas and Washington, had some very odd and notriously bad consumer laws, I know I live in Texas. But where they are lax in some respects they can be like a great hammer falling on some heads for other laws that other states would say a business would not be responsible for. My mother being a paralegal for several years to a corporate catering law firm allowed me to hear about cases later. Wierd things you didn't think you could fight would be fought and won. Just because those are the laws.

However, bait and switch IS an illegal practice here in Texas and what they have done is illegal. However, as a Californian getting them to enforce that law on Dell is probably an excercise in futility. You need a Texas resident to make a complaint.

YEP - This has nothing to do with advertised prices (online, newspaper, flyer etc.) for B&M stores either.

I spent the better part of last night playing with the monitor, rather than taking pictures of it.

Note: The reason 4 were purchased is simple. 3 of us in the office wanted them when we saw the deal, so we had one of us purchase all 4 (I'm the one that bought two). Two arrived yesterday, where I took 1 home, and the guy that paid for all 4 took the other home, in the event that Dell decided to not send us the other 2 that we'd bought. I can only take a picture of the one that I have now. If that's enough for now, I'll do it this evening.

Sadly, the more I think about it, the more I'd wished I'd bought more. Check eBay for 2405's. Since 2 days ago and now, it went from only having 2 listed to MANY more (so I'd venture that while it seems a lot of people weren't very lucky here, there were others who were). I'd wait 2-3 months and throw em up there and make a killing heh.
