I basically told them, yes you will issue me a back order. The item IS advertised for sale, even if it is listed out of stock, on your website. You Sunday ad says ALL PNY graphic cards will recieve a 30% discount for the duration of the advertisement. This got their attention and I got to speak with a CSR manager, for whatever it was worth. I recieved a Case nuber 1-75571539 for my trouble and was notified it will be resolved in 48 hours. If in 48 hours I have not recieved the card for the specified amount or a rain check I will be taking more drastic measures.

By the law this is deceptive advertising and bait&switch practices. If need be, I will show up on the doorstep with a lawyer and a cop ready to write a ticket to the store. Done it before and I'll do it again.

It's not my fault they neither wrote down limited stock/quanities/locations nor an exclusion for brand new products. Those that are rolling over on this issue should grow some back bone and show compusa they can't pull crap like this.

If the numbers are not limited, but the store is out of the item, ask for a "rain check." A rain check lets you buy a sale item at the sale price when the store has it in stock later on.

"Bait and switch" is against Missouri and federal law. Report any store that tries a "bait and switch" to the Attorney General's Consumer Fraud Hotline at 800-392-8222.

Well to further this... I already filed an official complaint through my state's consumer protection website.

Notice chapter 17 article 48 and on. These deal with all the deceptive acts herein perpetuated by compusa. I have taken down names and numbers of everyone I have spoken with. I also am giving CompUSA a chance to redeem themselves by either selling me the item right now at the advertised price or to offer a raincheck for that advertised item at that price. If they refuse to do either I will let the BBB know, every consumer watch group, I've already called a relative of mine who's an attorney and will get in contact with a consumer protection attorney, and might even let KENS5 consumer news hotline in on it. I'm sure they would love to eat up a news story about a bad deal made by a big company.

I advocate everyone else do the same and read the consumer protection laws as they pertain to you in your state.

Be aware... the advertisement in the fine print does say stores in Abilene, Waco, and McAllen may or may not participate in advertisement specials. That is fine because I'm not living in those cities. This is wrong, illegal, and needs to be corrected.

right on HumblePie. at least Texas law lays the smack down on B&S scams. you are absolutely right, they advertised all PNY, no exemptions. if their marketing guys are that, well... stupid, then they should live with their stupidity. at my office when we price something to low, we suck it up. as bad as it may be. i dont see why a major company should do any less. all it would have taken was an in-stock items only quote.

OTOH. if they do honor this deal i guarantee ill send them a lot more of my business.

Lowenbotten, yah getting the graphics card at advertised price would be nice, but it would not make ANY difference be it a graphics card OR another product if this false advertisement tactic was pulled. Why? Because there are CONSUMER PROTECTION LAWS and they are put there for reason. The fact remains, a company posted an advertisement with no limitations on it other then time frame for a said product. They were selling that said product. They then refused to honor the deal for that said prodcut. That is against the LAW.

I'm in this now for the principle of it and the fact they are lying. They flippantly have said more then a few times to my face that they do not do backorders. Then when I persisted they said they could sell it as a backorder for FULL price. Sorry. That is again, against the law. Those laws are there to tell businesses that bait and switch tactics such as this will not be tolerated. Your defeatist attitude of letting them get away with it allows them to perpetuate this kind of skuldrudgery.

I suggest Lowenbottom if you have nothing contructive to say and would rather flame someone for being persuant of the law, then I advise you next time you get a speeding ticket you yell at the officer and say he's only trying to make his quota or make money for next year's budget.

As for which store, There is only one here in San Antonio, Texas off 820 Rector Street number 210-348-0880.

No matter how you look at it lowenbotten, this is illegal if they list it as sold out and they won't allow for rainchecks. Unless they specified otherwise, which they didn't.

The problem isn't that they messed up once. They will do this again, and if they get away with it then they will continue to do it. Besides, itts not like CompUSA will go out of business over this.

I don't think he cares, scanning through Hot deals I've seen about 3-4 posts from him in the last ~hour, and they're always ripping on someone. Just ignore him, and move on.

No, same thing happens all the time with other products which piss me off. Most of these laws were inacted because of the practice of shady car dealers. They'd lure you in with offers on cars but when you get there, the cars they have on the lot aren't the ones in the ad.

I've been to dealerships that had special rebates and cash back offers for cars and said they pertained to all cars but when I get there they forgot to mention in the ad they don't pertain to the newest one off the line. This is why most major car advertisements have 20 lines of fine print below them or if you hear it on the TV/radio then you can barely hear some guy mumbling as fast as he can in a low voice all the restrictions of the advertisement. Which is illegal to present exemptions to the advertisement in that way in some states.

Look fact is, they advertise 30% off all cards with no exemption. I want that card. They advertise they are selling that card by the website. Neither advertisement contradicted each other. The web originally said in stores 7/1. Then it said out of stock, and now it says out of stock and web only. WEBSITES, even ones that you can purchase products off of are still considered advertisements. So that means this product was advertised FOR SALE during the specified time frame of the 30% off ad. This means they must honor rainchecks IN MY STATE. Maybe not yours, there are federal laws but they allow states to make exceptions. The fact they refused initially to back order it for me, and then said yes but at full price is plain WRONG. It's illegal, despicable, and underhanded business practices. That should not be tolerated under any circumstances.

I don't post much on these forums, but I agree with Lowenbottom, and do have something constructive to say. Theres a disclaimer right in the ad at the bottom of the page "Product availability may vary in stores and online", can logically imply that what's available online may not be available instore. This is from the City of Industry CA Ad.


The disclaimer says that and that not all offers are available online. BUT saying that Product availability may vary does NOT state that products which are out of stock can not be rain checked, unless discontinued. Sorry... no where in the ad or disclaimer does it say... Products not available or out-of-stock will not be covered under this advertisement. They CAN NOT list that anywhere because it would be ILLEGAL. You can not list an advertisement for a item you do not have in stock and refuse to offer a back order sale on.

Anyhow, this is why CrapUSSR has switched the item from store to web only. I went to my store again after work today and spoke with the general manager. When I presented to him a law book I picked up, stating the consumer protection laws as they pertain to Texas right after he said to me, they don't do rainchecks... man you should have seen the look on his face. At this point he was willing to give me the raincheck but unfortunately, the corporate dunderheads have removed any store ability to place an order for any item. The item will now ONLY be sold on the web and will never reach store shelves. They are thinking they are getting around a loop-hole in the law.

The problem is, the website specifically stated earlier in the week for IN STORE PURCHASE. This was an INSTORE advertisement. As such they must honor it. By switching it over from in-store to web only so that the instore advertisement doesn't apply to the website is completelty bogus.

Ofacto, and anyone else that wants to say otherwise, this was a legality issue and I'm persuing it to the full extent of the law.

I still haven't gotten a call yet, so I think mines still coming. BTW I spoke with a lawyer today and he thinks that if you prepayed, they have to honor that agreement, even if that means paying the differerence for you to buy it at another store.

Here is my take on THIS compusa did in FACT have these cards INSTOCK! They have sold out what they did have ONLINE.Now this said these aren't fresh new cards they have not stocked or sold yet.By this they should give ALL the NEW Customers a deal on this card based on selling them befor,OR they should have restructured there AD.
Now I belive CompUSSR new weeks back when they sold those ORIGINAL 6800 ULTRAs they had INSTOCK they were fixing to have this July4th week sales AD.They in turn have delayed most of the ORDERS the took @ the begining of the month of JUNE.For this I belive they Intended to keep them selves from haveing to honor there Low Price Policy,what is it 14 /30 days something like that.All those people would be eligible to get the 30% right NOW and should be allowed to do so,and most likely are that bought the cards around June 7th.This has not been 30 days ago.
I see they say the 6800 ULTRA is WEB ONLY so I don't know if that is a new update or not?
But I do know this the WEB did sell some of these cards and (1)should honor rain checks or backorders or (2)never stock or sell one again*!*

OK guys ..remember this is Compusa..there customer service in general sucks(though the manager in Melbourne,FL store was good)

Unfortunately, even BB is becoming like this..I pretty much stay away from these 2 stores .....sad...but if people would stop buying from them there policies would change...eg CC used to have a restocking fee and have done away with it..I am not surprised they pulled this crap when they realized what was going to happen...I hope someone can get them in hot water over these BS ads...and not honoring them
