It seems like Dell just hired some new guy that has been making all these mistakes.

This system, if you do it now after all the discount and rebate it's down to about $800 but it seem mistake and downloaded to $139 + Tax.

Before there was a 200Gig hard drive down for $20. And that's after 2 of $100 rebates.

To me, they have a very good reputation. But if they don't honor what they put on the web, then I guess it is safe to say everything they put on their web is not 100% honored by them.

If it's hacker that put on their web, then I say they have a sh*tty security and always call them to verify when I buy something.

CompUSSR also claimed to have been "hacked" in that entire Sony DRU-510A fiasco. It's an easy excuse to say you're "hacked," but if you think about it saying stuff like that will definitely hurt you in the long run, because of people being so neurotic with their credit cards online.

Anyone who didn't realize that this might not go through when they placed their order is an idiot. Mistakes are unfortunate, but they happen. Dell is a lot more upset about this mistake than any of you, I can guarantee you that. All you lose is a little time, which you chose to risk when you tried to get on this deal in the first place. If they honor it, then that's a nice bonus, but I don't expect them to, nor will I be upset when they don't. If the volume was lower, they would probably be inclined to let it go, the loss would be minor, not worth the loss of reputation for cancelling the orders. Too bad that's not the case.

Situation:

On 10/9/2003 a Pricing Error was posted on <<<www.dell.com>>> that was advertised through the Affiliates channel. This was specific to one specific order code on the Dimension 4600. List price was $1299 discounted to $899 after a $400 discount. The errors allowed delete down configuration of the system to get to $239, less an additional $100 rebate for a total price of $139.

Actions Taken:

Order currently in DOMS that are IP/HL are in the process of being cancelled. Orders that were processed through the site but have not been completed in DOMS will also be cancelled.
Messaging to customers is being sent via email to address listed on the online order.

Communication with Customers:

Dear Valued Customer,

In reference to your order for a Dimension 4600 that you have placed online, it has come to our attention that pricing on your order was in error. Dell cannot be responsible for errors, omissions, or consequences of misuse of site and its functions. Because of this your orders have been cancelled.

update I ordered at 9:27A.M. this morning and only orderd 1 system and my order was cancelled so I don't think ANYONE is getting one.

Frankly if they'd send me the system and not honour the $100 MIR I'd take that as a reasonable settlement (though they'd probably still be losing money on the deal).

It's called quid pro quo, and it's the most basic legal term that its binding. It means "a fair trade".

Essentially, It means that no contract is binding until someone charges you or they get something in return. Any order for $0 is never a binding contract because the opposite party doesn't get anything in return.

As for this deal, unless your credit card was charged, I doubt they would honor them. If I were Dell, I sure as heck would not honor the mistake. You're not gonna buy from them anyways, so they might as well screw you.

As for the "not our fault" policy, sure it's legal. The same laws that you use to protect yourself online they can use to protect themselves. It's different in a city because there's an actual storefront, and I don't believe there exists any federal laws requiring businesses to honor sales for interstate commerce. All the laws are state laws.

Ordered one this morning, got ack. and confirm. No email yet, but looked up order number and Dell says the order has been cancelled.

Even assuming this is some form of error, an operation as large as Dell should be able to do a better job of avoiding such embarassing mistakes. Why hassle their minefields of mistakes? It's more like playing the lottery than making a retail purchase of merchandise.

Oh well, at least they'll be sending the WD 200GB HD I ordered a couple weeks ago -- unless they don't. Caveat emptor!

On the "quid pro quo" thing -- that is also called "consideration." If someone did take Dell to court over this, he or she would have to show an economic loss -- i.e., that something was actually given up in order to enter the ostensible contract with Dell. An example would be a one-day-only sale that was bypassed in order to get the Dell saleprice.

None of that applies here. We can all get systems for the same price now as we could at the beginning of the day.

Sucks. I was hoping that they'd honor the one-per-person idea. You scumbags ordering 5 or 25 or whatever to re-sell (with a $79 S&H fee) on eBay are probably the same ones complaining that you won't give Dell your business.

A major "thanks" to the initial people sharing this deal, as they screwed themselves out of a great buy.

So what's the farthest anybody's order has gotten?

Mine is currently in the "testing" phase.

My system had a Radeon 9800 and 1901fp monitor.

I started to boycott dell after last year's rebate scam they pulled.

For all those defending them: if you are long enough on these boards, you would see a pattern emerge.
Every few month dell scams people with these tricks to get consumers information and attention.

They have a great marketing machinery, most uneducated people BELIEVE dell has good products, but they use the cheapest components and the dirtiest sales tactics (just as this one).

I was suprised to learn that many IT departements in universities boycott dell for the same reason.
They are professionals, they should know.

Since last year I do an active badmouthing (basically stating the facts) in meetings and parties and redirecting people to other opportunities.

Dell Computers also come from China, they are not a true US company where the products are made in America. Although they are a true American company that makes a cheap product by making it overseas.
