Dell seems to have quite a few "pricing errors" or "selling items without sufficient inventory" lately....

I wonder what is happening to Michael Dell's company?

Too much reliance on foreign employees?

Poor Inventory Management/Forecasting software?

Poor Web Site Developers?

Poor Customer Service?

That being said, I still buy their PCs because I can't build them that cheap anymore!

this line from the email is something else:

"We truly value our relationship and reputation with our customers."

Words are so cheap when it comes to these corporations these days. At least give a $5 gift certificate or something.

His company should sell more computers and Dell branded products rather than just junk. My opinion in general, doesn't really have anything to do with the HDD deal.

You realize that if say, Best Buy, accidentally prices a PS3 at 99.00 in the store, they legally have to sell it to someone at that price if they find it, don't you? They can go and look and change any other mistakes they find afterwards.

I would imagine though that if they mispriced 50 of them and 50 people tried to buy them at the same time they'd try and stop it.

There comes a point where YOU have to take responsibility for YOUR mistakes. Going back to thier 8800 fiasco from BF, Dell does seem to believe they are above having to take responsibility for anything.

Selling thousands of cards we don't have and never get: Not our fault.
Mispricing an item and then cancelling all orders: Not our fault.

And that's the track record I know of. There seem to have been instances of similar behaviour prior to the 8800's, too. At some point they need to own up to their mistakes.

Stay out of business law, you're completely wrong.

If the cashier has the wherewithal to call a manager when that PS3 rings up at $99, the store can correct that price, then ask if you still want to continue the sale.

Yes, if the cashier did not realize the mistake and allowed the sale to continue, then it's fine. Once the entire transaction is complete, they can't require you to return an item. But a transaction is not complete until payment has been rendered and merchandise has been delivered. Dell, just like in the hypothetical above, caught the error before delivering the goods. The transaction was incomplete, and they had every right to terminate the sale.

I agree that Dell is a huge world-wide company, not just based in Round Rock, TX any more.

My gripe was that they continually have "obvious pricing mistakes" and "take orders for items they do not have in stock, nor can they obtain in a reasonable amount of time".

It is my assumption that these web pages should checked and double checked before going online.

It is also my assumption that they should use a better web-based E-Commerce solution that does not allow several thousand orders for items not in stock or with a ridiculously long lead-time.

These are simple concepts of business that a company as large as Dell should understand.

I do not want "something for nothing"... I am a bargain hunter like the rest of you. I did not order 1.5 TB Hi-Speed USB / eSATA-300 Duo Pro Drive External Hard Drive $68 + $8 shipping from Dell because I knew it would be canceled. I did order a 8800GT beacuse $207.00 is reasonable for this item.

My gripe is that they should be much more careful with their business or they will get a bad reputation. They probably do not care about their reputation now that they are so large a company and will continue to make profits, reputation in tact or not.

It would be very nice to be able to select a Customer Care Rep. that does not speak with an accent so that we can communicate.

Sorry to rant.... I feel better now

Under your logic you could state the following:
I take a girl home... she says yes she wants to have sex with me, but later says no. Under your logic I can rape her, because she has to honor the original agreement. What a joke. If the goods haven't passed, take it easy, and give them a break. Sensational? Yes. But seriously these threads fill up with this crap every time there's a price mistake.

In California, if the price is actually posted in the store, they have to sell it to you.
Even if the price tag has expired, but it is still posted, they have to sell it to you.

I can't tell you about other states.

Now an ad in the newspaper is different. Mistakes are often the fault of the newspaper and a disclaimer is often posted in the store regarding this. Fry's has this happen ocassionally. But this is in regard to the posted price on a shelf. They have to sell it to you in CA.
I realize this seems to be hijacking the OPs thread, but this was an obvious price mistake.

Even with the California law, the retailer has the right to refuse sales for any (non-discriminatory) reason. In both scenarios, the retailer catches the mistake before the transaction is complete. In the Best Buy hypothetical, they can halt the transaction, replace the incorrect price postings, and give the customer the opportunity to restart the transaction. In the case of a supermarket "overcharging", its probably not worth their effort to do so, so they honor the incorrect price while updating the postings. For the Best Buy case, it probably is worthwhile to correct the issue. For Dell, with thousands of people trying to scam the system, it most definitely is worth the effort.

this is a case where the law give extra protection to a corporation. if i as an individual, was to make a mistake i'd be held liable, but in the case of a corporation they can work some legal maneuver to mitigate their mistake.

That is crap, stop acting like a freaking victim. If you put a classified ad in the paper to see a brand new, unopened PS3 for $70 instead of $700, people can't bring that ad to your house and demand you honor the price. If they leave a check and wait for delivery, you as a seller always have the option of unilaterally canceling the transaction and returning the money.
