The reason you would want to call a lawyer is to get his help in negotiating something where you don't get charged in the first place. An ounce of prevention is worth a pound of cure. Why wait for the problem to get that big? That is, for lack of a better word, really stupid.

It seems as though this e-tailer has "fired a warning shot across his bow." A few minutes with a lawyer competent to practice law in his jurisdiction could be worth it for peace of mind, or to help you cover your ass.

Unlike what JZero said about leaving his car unlocked, this has nothing to do with it. Nothing was STOLEN here. The moral issues are certainly not a topic of issue, this is downright immoral. But the real question is whether this is illegal.
The point which you missed was not about theft, it's the fact that claiming that the hole was already there and you just took advantage of the hole isn't going to exonerate you of any wrongdoing.
If you need to use a more direct analogy, take your own about switching the 50% off sticker, but then later claiming the fact that the 50% off sticker was removable in the first place as a reason you should not be held responsible for your actions.
If this happens to be a crime, the defense of "It's their fault for having the flaw in the system, not mine for taking advantage of it" won't hold water.

1) was what he did wrong? There was a flaw in the website ordering system which allowed him to order the items for great discount. is he responsible for Finding the flaw and using it?
If you find your neighbor's door unlocked, are you responsible for stealing from their house? YES!
2) Is it legal for them to ask him to ship back things that has already reached him and infact his credit cards have been charged ( the discounted price) and he has valid receipts from the merchant?
It's better than being charged with various crimes which could include felony charges if the amount is high enough and could be Federal offenses if he is in different state from the merchant.
3) Can they file a case against him or any other legal action?
HELL, YES! If he doesn't return or pay for everything, I hope they throw the book at him. :disgust:
4) he sold few of the items and has some with him and he has no issue with returning the items he has with him but if he returns the items can they be used as some form of evidence against him?
He should pay for their posted price items and be glad if they let him go with that.
5)he really does not want to get in any form of legal mess. he thought that what he did was legal as the website was letting him place the orders and they had every right to cancel them or not ship them....but they did....

As mentioned before he did not change anything on the website. he did not break into their servers or anything.... all he did was change the itemID on the URL and it worked...

he is very scared and i felt I can help him.
IF he returns or pays for everything, the only thing he should be scared of is that he's too stupid to survive very long because he didn't figure it out before he acted. Otherwise, he should be very scared that he will be spreading his lower cheeks for his new cellmate, Bubbah. :|

P.S. If you really couldn't figure it out, I would think you are also a few frejoles short of a combination plate.

Fraud!! And maybe even hacking. He found a flaw in their system and took advantage of it for his own gain. Isn't that what Hackers do?

I'm with Viper on this one. He was idiot enough to post it. Why in the hell should anybody edit a quote?

Can you explain to us why you would require us to do so? What is your rationale?

I dont recall requiring you to do so. He's obviously received legal advice that's its not good for his friend that the situation is publically posted to and admitted; he's attempted to rectify that and all I said was I think its polite if user's help the guy out a little instead of being an ass and keeping the quotes just for the sake of keeping the quotes.
